z_index_tablet=\u00bb500″]<\/p>\n La Organizaci\u00f3n de Naciones Unidas (ONU) est\u00e1 conformada por 192 pa\u00edses del mundo, que se re\u00fanen para trabajar a favor de la paz y seguridad de los pueblos. Luego de m\u00e1s de 20 a\u00f1os desde la creaci\u00f3n del Grupo de Trabajo sobre las Poblaciones Ind\u00edgenas, el 13 de septiembre de 2007 la ONU adopt\u00f3 la Declaraci\u00f3n sobre los Derechos de los Pueblos Ind\u00edgenas (DDPI o por sus siglas en ingl\u00e9s UNDRIP).<\/p>\n La lentitud del proceso se relacion\u00f3 con la preocupaci\u00f3n de varios pa\u00edses acerca de los proyectos de auto-determinaci\u00f3n y control de recursos naturales en las tierras ancestrales ind\u00edgenas. Es as\u00ed que cuatro pa\u00edses votaron en contra (Estados Unidos, Canad\u00e1, Australia y Nueva Zelanda) aunque posteriormente revirtieron su postura.<\/p>\n Todos los pa\u00edses Latinoamericanos adhieren a este tratado internacional que constituye un hito en la historia universal de los derechos de los pueblos ind\u00edgenas.<\/p>\n A diferencia del Convenio 169, la DDPI no tiene rango de tratado internacional jur\u00eddicamente obligatorio. Por lo tanto no es vinculante u obligatorio para los pa\u00edses miembros de la ONU, sino que es declarativo u orientativo: un ideal com\u00fan acerca de los derechos individuales y colectivos de los pueblos ind\u00edgenas, y un registro del compromiso de los estados a tomar medidas para garantizar su cumplimiento. Su valor es pol\u00edtico, \u00e9tico y moral; pero no genera obligaciones jur\u00eddicas. No obstante, puede usarse para guiar proyectos de leyes, pol\u00edticas p\u00fablicas y para guiar las decisiones judiciales sobre asuntos ind\u00edgenas.<\/p>\n Existen algunas excepciones con respecto a la obligatoriedad de este instrumento, que en su art\u00edculo 38 define que \u201cLos Estados, en consulta y cooperaci\u00f3n con los pueblos ind\u00edgenas, adoptar\u00e1n las medidas apropiadas, incluidas medidas legislativas, para alcanzar los fines de la presente Declaraci\u00f3n\u201d. Ciertos pa\u00edses hicieron caso de este art\u00edculo, dando fuerza de ley nacional a la DDPI: Bolivia (Ley N\u00ba 3760), Ecuador (Constituci\u00f3n Nacional) y Argentina (Art. 75 de la Constituci\u00f3n Nacional). Estuvieron implicados en cada etapa del establecimiento de las normas que contiene la DDPI.<\/p>\n
La Declaraci\u00f3n incluye normas m\u00ednimas para la supervivencia, la dignidad y el bienestar de los pueblos ind\u00edgenas del mundo.
