La comunidad agot\u00f3 las instancias jur\u00eddicas nacionales sin recibir respuesta, y en 1996 present\u00f3 su caso a la CIDH, la cual concluy\u00f3 que:<\/p>\n<p>\u201c\u2026 al otorgar una concesi\u00f3n para aprovechamiento forestal dentro de la tierra tradicional de la Comunidad sin consultar su opini\u00f3n, el Estado viol\u00f3 una combinaci\u00f3n de art\u00edculos consagrados en la Convenci\u00f3n Americana de Derechos Humanos: Derecho a la Vida, a la Protecci\u00f3n de la Honra y de la Dignidad; a la Libertad de Conciencia y de Religi\u00f3n; a la Libertad de Asociaci\u00f3n; a la Protecci\u00f3n a la Familia; a la Circulaci\u00f3n y Residencia; y Derechos Pol\u00edticos\u201d<\/p>\n<p>En el a\u00f1o 2001, la CIDH fall\u00f3 a favor de la comunidad, estableciendo que:<\/p>\n<ul>\n<li><strong>El Estado de Nicaragua deb\u00eda demarcar y titular los territorios ind\u00edgenas de esta comunidad, y todas las tierras comunales ind\u00edgenas del pa\u00eds,<\/strong> con la participaci\u00f3n de la Comunidad, conforme a su derecho consuetudinario, y en un plazo de tiempo.<\/li>\n<li>\u00a0Se <strong>prohibieron las explotaciones<\/strong> en ese territorio, tanto del propio Estado como de terceros.<\/li>\n<\/ul>\n<p>Este caso gener\u00f3 el primer pronunciamiento de la CIDH a favor del<strong> derecho ind\u00edgena colectivo al territorio y a los recursos naturales,<\/strong> conforme a su propio derecho consuetudinario y pr\u00e1cticas tradicionales;
