Al igual que en el caso de la Comunidad Sawhoyamaxa, la comunidad Yakye Axa perdi\u00f3 su territorio durante la Guerra del Chaco, para convertirse en empleados explotados por la Estancia Loma Verde, asentada sobre tierras que actualmente reclaman como propias. En 1979 la iglesia anglicana inici\u00f3 un proyecto de desarrollo para las comunidades ind\u00edgenas y compraron extensiones de terrenos, entre ellas una estancia denominada \u201cEl Estribo\u201d, hacia la cual se trasladaron los miembros de la Comunidad Yakye Axa. Sin embargo, sus condiciones de vida no mejoraron, y en 1993 deciden retornar a la Estancia Loma Verde, cuyo propietario les proh\u00edbe el acceso. Desde entonces, se establecieron en un asentamiento al costado de la ruta y frente al alambrado de la estancia, e iniciaron el reclamo de sus tierras, sin respuestas por parte del Estado Paraguayo. Por las condiciones de pobreza extrema en el asentamiento, diecis\u00e9is personas fallecieron durante el per\u00edodo de reclamo por sus territorios.<\/p>\n
En el a\u00f1o 2000, la comunidad denunci\u00f3 al Estado Paraguayo ante la Comisi\u00f3n Interamericana de Derechos Humanos, por no reconocer la propiedad de sus territorios ancestrales.<\/p>\n
En 2005, la CIDH dictamin\u00f3 a favor de la comunidad, al considerar que Paraguay no adopt\u00f3 las medidas necesarias para garantizar las tierras tradicionales de la comunidad, amenzando su cultura, y violando los derechos a la propiedad y a la protecci\u00f3n judicial, como tambi\u00e9n el derecho a la vida, al privar a la comunidad de sus medios de subsistencia tradicionales, y al no otorgarles condiciones de vida dignas. La Corte orden\u00f3 al Estado las siguientes medidas de reparaci\u00f3n:<\/p>\n
\u201cIdentificar el territorio tradicional de los miembros de la Comunidad ind\u00edgena Yakye Axa y entreg\u00e1rselos de manera gratuita en un plazo m\u00e1ximo de tres a\u00f1os, dado que perdieron sus territorios por causas ajenas a su voluntad. Y mientras la comunidad contin\u00fae sin tierras, el Estado debe suministrarles los bienes y servicios b\u00e1sicos necesarios para su subsistencia: agua, alimentos, atenci\u00f3n m\u00e9dica, medicinas y materiales escolares\u201d.<\/p>\n
Adoptar medidas legislativas y administrativas en su derecho interno, para garantizar el efectivo goce del derecho a la propiedad de los miembros de los pueblos ind\u00edgenas; y efectuar pagos por da\u00f1os materiales y gastos del litigio.<\/p>\n
A pesar de lo establecido en la Sentencia, el Paraguay no ha cumplido con las reparaciones correspondientes hasta la fecha, impidiendo as\u00ed una mejora en las condiciones de vida de los miembros de la Comunidad, quienes viven desde hace varios a\u00f1os en un grado de vulnerabilidad extrema.<\/p>\n
