En 1986 las fuerzas armadas de Surinam atacaron a la comunidad N\u00b4djuka Maroon de Moiwana, masacrando a m\u00e1s de 40 hombres, mujeres y ni\u00f1os y destruyendo la comunidad. Los que lograron escapar, fueron exiliados o desplazados, perdiendo la posibilidad de retomar su estilo de vida tradicional.<\/p>\n

Al no haber ninguna investigaci\u00f3n sobre la masacre, en 1997 la comunidad present\u00f3 la denuncia ante la Comisi\u00f3n Interamericana de Derechos Humanos. Al ser el ataque anterior a la ratificaci\u00f3n de la Convenci\u00f3n Americana por parte de Surinam, la CIDH no pod\u00eda juzgar la masacre, pero s\u00ed las consecuencias de desplazamiento<\/strong> que se manten\u00edan vigentes y que fueron el objeto de la demanda.<\/p>\n

En 2002, el caso lleg\u00f3 a la CIDH, que en el a\u00f1o 2005 dictamin\u00f3 un precedente de gran importancia al considerar que:<\/p>\n

\u00abCuando los territorios ind\u00edgenas se han perdido por la violencia ejercida por terceros, o por actoslegislativos o administrativos no consentidos por los pueblos ind\u00edgenas; entonces el derecho territorial no se vincula a la posesi\u00f3n actual, sino a la tradicional.\u00bb<\/strong><\/p>\n

Consider\u00f3 entonces que los miembros del pueblo N\u2019djuka eran \u201clos due\u00f1os leg\u00edtimos de sus tierras tradicionales\u201d a pesar de no tener su posesi\u00f3n, porque salieron de ellas como consecuencia de actos de violencia que se produjeron en su contra.<\/p>\n
