En el a\u00f1o 2000, los candidatos a alcaldes, vicealcaldes y concejales de este partido, fueron excluidos de la posibilidad de participar en las elecciones municipales realizadas de las Regiones del Atl\u00e1ntico Norte y Atl\u00e1ntico Sur.<\/p>\n<p>En 2001, el caso fue presentado a la Comisi\u00f3n Interamericana de Derechos Humanos, la cual destac\u00f3 que este partido se reg\u00eda por un sistema organizativo ancestral basado en asambleas comunales, barriales, territoriales y regionales que no era reconocido por la Ley Electoral.<\/p>\n<p>En el 2005 la CIDH decidi\u00f3 por unanimidad a favor del partido YATAMA: El Estado Nicarag\u00fcense viol\u00f3 los derechos a garant\u00edas judiciales, a la protecci\u00f3n judicial y los derechos pol\u00edticos y de igualdad ante la ley, por lo que deber\u00e1:<\/p>\n<ul>\n<li>adoptar las medidas legislativas necesarias para establecer un recurso jur\u00eddico sencillo y efectivo que permita controlar las decisiones del Consejo Supremo Electoral que afecten los derechos humanos;<\/li>\n<li>reformar la Ley Electoral <em><strong>asegurando la participaci\u00f3n de los miembros de comunidades ind\u00edgenas en los procesos electorales, en forma efectiva y tomando en cuenta sus tradiciones, usos y costumbres.<\/strong><\/em><\/li>\n<li>indemnizar a YATAMA por los da\u00f1os materiales e inmateriales y pagar los costos del proceso judicial.<\/li>\n<\/ul>\n<p>Esta fue la primera sentencia de la CIDH sobre derechos pol\u00edticos, y permiti\u00f3 crear jurisprudencia sobre la participaci\u00f3n de los pueblos ind\u00edgenas en las elecciones de representantes municipales.<\/p>\n<p><strong>Para saber m\u00e1s sobre este caso te recomendamos:<\/strong><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row][et_pb_column type=\u00bb1_4&#8243;][et_pb_image _builder_version=\u00bb3.22.5&#8243;
