La consulta ser\u00e1 de conformidad a sus normas y procedimientos propios como \u00fanico requisito exigible (Art. 293). La decisi\u00f3n de convertir un municipio en AIOC, se adoptar\u00e1 mediante referendo (Art. 294); al igual que la decisi\u00f3n de agregar municipios, distritos municipales y\/o AIOC para conformar una regi\u00f3n ind\u00edgena (Art. 295).<\/p>\n A las AIOC les corresponde elaborar su Estatuto de acuerdo a sus normas y procedimientos propios, seg\u00fan la Constituci\u00f3n y la Ley (Art. 292); y ejercer su propio gobierno a trav\u00e9s de sus propias normas y formas de organizaci\u00f3n (Art. 296). Ley Marco de Autonom\u00eda y descentralizaci\u00f3n \u201cAndr\u00e9s Ib\u00e1\u00f1ez\u201d (2010)<\/strong><\/p>\n Esta ley regula el r\u00e9gimen de autonom\u00edas (AIOC), y define a los Territorios Ind\u00edgenas Originario Campesinos (TIOC) como el territorio ancestral sobre el cual se constituyeron las tierras colectivas o comunitarias de origen, debidamente consolidadas, mediante el procedimiento correspondiente ante la autoridad agraria (link a secci\u00f3n territorio).<\/p>\n Son Funciones Generales de la AIOC impulsar el desarrollo integral como naciones y pueblos, as\u00ed como la gesti\u00f3n de su territorio (Art. 8). La autonom\u00eda se ejerce a trav\u00e9s de:<\/p>\n 1. <\/strong>La libre elecci\u00f3n de autoridades De acuerdo a la CNE, se establece como AIOC a los territorios ind\u00edgena originario campesinos, y los municipios, y regiones que adoptan tal cualidad (Art. 291). Es decir, que tanto los TIOC titulados, como los municipios con mayor\u00eda ind\u00edgena, pueden aplicar a la AIOC. Por lo tanto, hay dos V\u00edas de Autonom\u00eda:<\/p>\n 1. La V\u00eda Territorial<\/strong><\/p>\n Un pueblo ind\u00edgena que ha recibido el t\u00edtulo de su TIOC, puede acceder a la AIOC. Esta es la v\u00eda preferida de los pueblos ind\u00edgenas de tierras bajas, que en general, la consideran como la forma m\u00e1s genuina de gobernanza. Sin embargo, tiene como complicaci\u00f3n que muchos territorios ind\u00edgenas no concuerdan en sus l\u00edmites con los l\u00edmites administrativos municipales o departamentales, por lo que existen resistencias de los municipios.<\/p>\n El Art. 293 de la CNE asigna Autonom\u00eda Ind\u00edgena a los territorios titulados, y a\u00fan a aquellos en proceso de titulaci\u00f3n como TIOC. Los mismos pueden conformar una unidad territorial y su gobierno propio ya con caracter\u00edsticas de jurisdicci\u00f3n territorial y entidad aut\u00f3noma, en todo el proceso de desarrollo auton\u00f3mico[1].<\/p>\n 2. La V\u00eda Municipal<\/strong><\/p>\n Un municipio con mayor\u00eda de poblaci\u00f3n ind\u00edgena puede solicitar convertirse en Municipio Ind\u00edgena. La decisi\u00f3n se adopta mediante referendo (Art. 294). En caso favorable; si la conformaci\u00f3n de la AIOC afecta l\u00edmites de distritos municipales, el pueblo ind\u00edgena y el gobierno municipal deben acordar una nueva delimitaci\u00f3n distrital. \u2022 Con respecto a las autoridades, la CNE establece que la democracia participativa y el derecho a la participaci\u00f3n; implica la elecci\u00f3n, designaci\u00f3n o nominaci\u00f3n de autoridades y representantes por normas y procedimientos propios de las naciones y pueblos ind\u00edgenas (Art. 11 y 26).<\/p>\n
De esta forma, la Constituci\u00f3n reconoce las formas de gobierno tradicionales, y la posibilidad de ejercer la autoridad administrativa-pol\u00edtico en el territorio, contando para ello con recursos del Estado. La AIOC implica funciones ejecutivas, legislativas, normativas (basado en usos y costumbres) y judiciales. Seg\u00fan establece el Art. 410 de la CNE, la AIOC tiene el mismo valor que las dem\u00e1s autonom\u00edas (departamental, regional y municipal).<\/p>\n
