Tras d\u00e9cadas de actividad petrolera en territorios del Pueblo Guaran\u00ed en Bolivia, en el 2007 se sancion\u00f3 el Reglamento de consulta y participaci\u00f3n de los pueblos ind\u00edgenas y comunidades campesinas en actividades hidrocarbur\u00edferas. Con esta herramienta legal, el Pueblo Guaran\u00ed recondujo a trav\u00e9s de sus propias instancias de gobierno un Proceso de Consulta previo a la exploraci\u00f3n hidrocarbur\u00edfera. Uno de los aspectos m\u00e1s interesante del proceso fue la participaci\u00f3n de una Red Ind\u00edgena de Monitores Socioambientales.<\/p>\n

Informaci\u00f3n General<\/strong>
El Municipio de Charagua es el m\u00e1s extenso de Bolivia, con una superficie de 71.745 Km2, que representa el 6,5% del territorio boliviano . En este municipio hay cuatro Territorios Ind\u00edgenas Originarios Campesinos (TIOC). Uno de ellos es el TIOC Charagua Norte, que se ubica en el sector oeste del Municipio y comprende a 30 comunidades de la Naci\u00f3n Guaran\u00ed, con una poblaci\u00f3n de 7200 personas .
TIOC Charagua Norte tiene una superficie titulada de 1091.62 km\u00b2, y este es el mapa del territorio:<\/p>\n

PLUSPETROL y un Proceso de Consulta rechazado por los ind\u00edgenas<\/strong>
A finales de los 90, Pluspetrol emprendi\u00f3 trabajos exploratorios en el TIOC Charagua Norte. Desde entonces, y hasta la actualidad, cerca de un 80% del territorio fue concesionado por el Estado a empresas petroleras.<\/p>\n

En el a\u00f1o 2007, se sancion\u00f3 el Reglamento de Consulta y Participaci\u00f3n de los Pueblos Ind\u00edgenas y Comunidades Campesinas en Actividades Hidrocarbur\u00edferas. Ante el cual, las empresas se vieron obligadas a solicitar el Consentimiento de los Pueblos Ind\u00edgenas titulares del territorio, para continuar con sus actividades (ver Recuadro Marco Legal).<\/p>\n

Ley N\u00b0 3058 de Hidrocarburos (2005) <\/strong>Establece la protecci\u00f3n del derecho de los pueblos ind\u00edgenas originarios y campesinos a la consulta y participaci\u00f3n cuando dentro de sus territorios se pretendan desarrollar actividades hidrocarbur\u00edferas (Art. 114 al 118 del Titulo VIII). En el 2009, Pluspetrol se propuso iniciar la Exploraci\u00f3n S\u00edsmica de los Campos Tacobo y Tajibo en el Bloque San Isidro, que abarcan tanto el territorio de Charagua Norte como el de la vecina TIOC Izozog. Es por ello que, de acuerdo al Reglamento, el Ministerio de Hidrocarburos y Energ\u00eda (MHE) inici\u00f3 un proceso de consulta referido a la Exploraci\u00f3n S\u00edsmica.<\/p>\n

Sin embargo, el procedimiento fue rechazado por los Guaran\u00ed, quienes no lo consideraron adecuado a sus propias formas de organizaci\u00f3n, fundamentalmente por dos motivos:
En primer lugar, porque la metodolog\u00eda de las reuniones no era pertinente a su cultura, sino que se realizaban a manera de exposiciones con diapositivas y en lenguaje t\u00e9cnico, a partir de una cartilla elaborada por la empresa, cuyos contenidos eran poco entendibles para los ind\u00edgenas.
En segundo lugar, porque no se daba participaci\u00f3n a las comunidades afectadas por el proyecto. El Pueblo Guaran\u00ed est\u00e1 organizado en Capitan\u00edas Zonales que nuclean a las comunidades de un espacio territorial com\u00fan. A su vez las Capitan\u00edas se reunen en la Asamblea del Pueblo Guaran\u00ed (APG), m\u00e1xima instancia de representaci\u00f3n ind\u00edgena de la Naci\u00f3n Guaran\u00ed. Las reuniones organizadas por el MHE se coordinaban con el Directorio de la Capitan\u00eda de la Charagua Norte, pero sin dar participaci\u00f3n a la Asamblea del Pueblo Guaran\u00ed (APG), ni a los miembros de las comunidades que ser\u00edan afectadas por la Exploraci\u00f3n.<\/p>\n

As\u00ed lo expresaba uno de los protagonistas:<\/strong><\/p>\n

\u201cLas consultas que ha hecho el Ministerio de Hidrocarburos tienen muchas deficiencias, porque se las hace con la dirigencia de las organizaciones ind\u00edgenas y campesinas y se omite hablar con las autoridades de cada comunidad\u201d<\/em><\/p>\n

\u201cLes dijimos: no queremos talleres, no queremos explicaciones te\u00f3ricas en Power Point, queremos explicaciones en nuestro idioma, queremos hacerlo con nuestros usos y costumbres y de acuerdo a los criterios t\u00e9cnicos que nos indican los monitores socioambientales Guaran\u00ed que viven en la zona\u201d<\/em><\/p>\n

Como contrapropuesta, la Asamblea del Pueblo Guaran\u00ed de Charagua Norte llev\u00f3 adelante la reconducci\u00f3n del Proceso de Consulta de acuerdo a sus propias formas de organizaci\u00f3n . En ese desarrollo, fue clave la participaci\u00f3n de la Red de Monitores Ind\u00edgenas Socioambientales.<\/p>\n

\nLas funciones de la Red son:<\/p>\n

\u2022 controlar y vigilar las actividades hidrocarbur\u00edferas en sus territorios;
\u2022 evaluar los efectos de sobre los Componentes socioambientales (aire, agua, suelo, fauna y flora); sobre los Componentes sociales, econ\u00f3micos, culturales y humanos de las comunidades incluyendo la salud humana; y sobre los Componentes jur\u00eddico institucionales.
\u2022 vigilar que las empresas prevengan, mitiguen y\/o disminuyan los impactos negativos de sus actividades, sobre dichos componentes.<\/p>\n

La Reconducci\u00f3n del Proceso de Consulta en Charagua Norte<\/strong><\/p>\n

En el a\u00f1o 2010, la Asamblea del Pueblo Guaran\u00ed de Charagua Norte reprogram\u00f3 el Procedimiento de Consulta para la Exploraci\u00f3n s\u00edsmica solicitada por Pluspetrol. El procedimiento eligi\u00f3 a las Asambleas Zonales como instancias tradicionales para la toma de decisiones, que permit\u00edan la participaci\u00f3n de todas las comunidades susceptibles de ser afectadas por el proyecto.
Dado que s\u00f3lo contaban con el Documento de Informaci\u00f3n elaborado por la empresa Repsol, los Guaran\u00ed solicitaron al Ministerio de Hidrocarburos la complementaci\u00f3n de la informaci\u00f3n relativa al proyecto: cartograf\u00eda y coordenadas de actividades y obras, etapas de desarrollo, planes de prevenci\u00f3n y mitigaci\u00f3n.<\/p>\n

La Primer Asamblea Zonal<\/strong> se desarroll\u00f3 en Charagua Norte con la participaci\u00f3n de la Directiva de la Capitan\u00eda; 60 dirigentes de 22 comunidades de Charagua Norte; 4 dirigentes de la APG Nacional y 2 de la vecina TIOC Izozog. En la misma se socializ\u00f3 la informaci\u00f3n sobre el proyecto exploratorio y se defini\u00f3 como equipo asesor local a la Red de Monitores de Charagua Norte.<\/p>\n

En la Segunda Asamblea Zonal<\/strong> con la participaci\u00f3n del Directorio de la Capitan\u00eda; 58 dirigentes de 21 comunidades de Charagua Norte; y 3 dirigentes de la APG Nacional, los Monitores de base de la Red organizaron 3 mesas de trabajo para coordinar el monitoreo de los posibles impactos de la Exploraci\u00f3n S\u00edsmica, sobre los componentes socioambientales y socioculturales de sus territorios.<\/p>\n

A continuaci\u00f3n, los Monitores Ind\u00edgenas de Charagua Norte, de Izozog y de la APG Nacional, y 1 t\u00e9cnico del MHE realizaron una Inspecci\u00f3n de campo<\/strong> a las zonas que ser\u00edan afectadas por la exploraci\u00f3n s\u00edsimica. En Mayo visitaron las comunidades de Taput\u00e1, Akae, Saipur\u00fa, Takur\u00fa, Masavi, Guariri, Tacobo, Ivitipora y el Carmen del Espino, y en Junio, inspeccionaron otras 20 comunidades de la TIOC.<\/p>\n

El equipo de monitores identific\u00f3 los impactos ambientales y sociales de la Exploraci\u00f3n S\u00edsmica, desde la percepci\u00f3n y conocimiento de los comunarios. Se realiz\u00f3 un Relevamiento de especies de flora silvestre y se identificaron los efectos del proyecto de exploraci\u00f3n sobre el agua, aire, suelo y sobre los Componentes sociales, econ\u00f3micos, culturales y la salud de las comunidades. \nPara cada impacto identificado, los Monitores y comunarios recomendaron medidas preventivas que la empresa deber\u00eda tomar en caso de que se ejecute el proyecto de exploraci\u00f3n.<\/p>\n

Posteriormente, se realiz\u00f3 la Tercer Asamblea Zonal con participaci\u00f3n de 26 comunidades de Charagua Norte, dirigentes de las Capitan\u00edas de Alto Isoso y Bajo Isoso, dirigentes de la APG Nacional, autoridades y t\u00e9cnicos del MHE y del Ministerio de Medio Ambiente y Agua, y un t\u00e9cnico de Yacimientos Petrol\u00edferos Fiscales Bolivianos (YPFB). Durante esta asamblea se revis\u00f3 detalladamente y se valid\u00f3 la informaci\u00f3n producida por la Red de Monitores ind\u00edgenas. Se determinaron impactos mitigables y no mitigables, y se acordaron formas de mitigaci\u00f3n y prevenci\u00f3n de los mismos. En el siguiente cuadro se ve un ejemplo con respecto al agua:<\/p>\n

De esta forma, se analiz\u00f3 cada uno de los componentes socioambientales, y se lleg\u00f3 a acuerdos con las autoridades ministeriales, respecto del proyecto de exploraci\u00f3n. Toda la informaci\u00f3n y acuerdos se plasmaron en un nuevo Documento de Informaci\u00f3n P\u00fablica, que esta vez recog\u00eda las evaluaciones del Pueblo Guaran\u00ed, y no solo las de la empresa petrolera.
Un hito trascendental para los Pueblos Ind\u00edgenas de Bolivia y el Continente, es que todos estos acuerdos tienen car\u00e1cter vinculante. As\u00ed lo especifica el Reglamento de consulta y participaci\u00f3n de los pueblos ind\u00edgenas y comunidades campesinas en actividades hidrocarbur\u00edferas. Es decir que el Estado, a trav\u00e9s del MHE, deber\u00e1 exigir a la empresa el estricto cumplimiento de los mismos.<\/p>\n

En conclusi\u00f3n<\/strong>
La experiencia de los Guaran\u00ed de Charagua Norte muestra el valor de las Asambleas como instancias de participaci\u00f3n absoluta de las comunidades ind\u00edgenas. El reconocimiento de las formas propias de organizaci\u00f3n y de toma de decisiones, no es s\u00f3lo un deber de las autoridades estatales, sino una ventaja para el desarrollo de Procedimientos de Consulta y Participaci\u00f3n.<\/p>\n

En Bolivia, este caso sent\u00f3 un precedente al Estado para los Procedimientos de Consulta de los Pueblos Ind\u00edgenas ante actividades de exploraci\u00f3n y explotaci\u00f3n de recursos naturales, y para otras actividades que afectan sus formas de vida, incluyendo proyectos de infraestructura, carreteras, hidroel\u00e9ctricos, y la planificaci\u00f3n y desarrollo de las pol\u00edticas p\u00fablicas del Estado.<\/p>\n
