El Estatuto del Indio (1973) en su Art. 3, define como:<\/p>\n
– Comunidad Ind\u00edgena o Grupo Tribal:<\/strong> al conjunto de familias o comunidades ind\u00edgenas que vive en completo aislamiento de la comunidad nacional, tiene contactos intermitentes o permanentes con ellos, sin estar integrados.<\/p>\n
Ratificado el 25 de Julio de 2002, as\u00ed como las resoluciones de los comit\u00e9s de quejas de la OIT sobre el cumplimiento del Convenio.
En Marzo de 2012, la Comisi\u00f3n de Expertos en Aplicaci\u00f3n de Convenios y Recomendaciones de la OIT public\u00f3 un informe sobre la violaci\u00f3n del Derecho a la Consulta de los Pueblos Ind\u00edgenas y el Convenio 169 en el Brasil. El informe confirma que el Estado debi\u00f3 consultar a los Pueblos Ind\u00edgenas en las m\u00e1rgenes del r\u00edo Xing\u00fa, previo a la construcci\u00f3n de la Represa de Belo Monte. El 24 de Enero de 1992, Brasil firm\u00f3 ambos Pactos Internacionales, y el Protocolo Facultativo del PIDCP. Pero hasta la fecha no ha firmado el Protocolo Facultativo del PIDESC, que permite presentar denuncias sobre la violaci\u00f3n de derechos econ\u00f3micos, sociales y culturales ante Naciones Unidas.<\/p>\n
Adoptada el 13 de Septiembre de 2007, por medio de su representante Piragibe Dos Santos Tarrago, quien se\u00f1al\u00f3 que \u201cBrasil subraya que el ejercicio de los derechos de los Pueblos Ind\u00edgenas debe ser consistente con la soberan\u00eda e integridad territorial de los Estados donde ellos residen\u201d.<\/p>\n
Brasil es parte de la Convenci\u00f3n Americana de Derechos Humanos (CADH) desde el a\u00f1o 1992, del Protocolo de San Salvador desde el a\u00f1o 1996, y de todos los tratados que integran el Sistema Interamericano de Protecci\u00f3n de los Derechos Humanos. A su vez, acepta la competencia de la Corte Interamericana de Derechos Humanos.<\/p>\n
