\u2022 Convenio 169 de la OIT<\/strong>
El 4 de Marzo de 1991, mediante la Ley 21, Colombia aprob\u00f3 el Convenio n\u00famero 169 sobre pueblos ind\u00edgenas y tribales en pa\u00edses independientes, adoptado por la Organizaci\u00f3n Internacional del Trabajo en 1989. El mismo contin\u00faa vigente, as\u00ed como las resoluciones de los comit\u00e9s de quejas de la OIT sobre el cumplimiento del Convenio.<\/p>\n

\u2022 Pactos Internacionales de Derechos Econ\u00f3micos, Sociales y Culturales (PIDESC) y de Derechos Civiles y Pol\u00edticos (PIDCP)<\/strong> Ambos fueron firmados en 1966 y ratificados el 29 de Octubre de 1969. Sin embargo, hasta el momento Colombia no ha firmado el Protocolo Facultativo del PIDESC (disponible desde 2008), que permite presentar denuncias sobre la violaci\u00f3n de derechos econ\u00f3micos, sociales y culturales ante Naciones Unidas.<\/p>\n

\u2022 Declaraci\u00f3n de Naciones Unidas sobre Pueblos Ind\u00edgenas<\/strong>
En el a\u00f1o 2007, cuando las Naciones Unidas realizaron las votaciones para adoptar esta Declaraci\u00f3n, Colombia fue el \u00fanico pa\u00eds latinoamericano que se abstuvo de firmarla.
En aquella ocasi\u00f3n, el delegado Jairo Montoya explic\u00f3 ante las Naciones Unidas que Colombia era uno de los pa\u00edses m\u00e1s avanzados en derechos ind\u00edgenas en su Constituci\u00f3n Nacional y que ciertos aspectos de la Declaraci\u00f3n estaban en contradicci\u00f3n con el sistema legal interno, especialmente los art\u00edculos sobre Derecho a la Consulta y el Consentimiento libre, previo e informado (Art. 19); la utilizaci\u00f3n de territorios ind\u00edgenas para actividades militares (Art. 30); y la consulta previa a la aprobaci\u00f3n de proyectos de explotaci\u00f3n de recursos minerales, h\u00eddricos y de otro tipo que afecten sus territorios (Art. 32); raz\u00f3n por la cual su pa\u00eds se absten\u00eda de votar la Declaraci\u00f3n.
Actualmente, Colombia ha revertido su postura firmando la Declaraci\u00f3n.<\/p>\n

\nColombia es parte de la Convenci\u00f3n Americana de Derechos Humanos (CADH) desde su firma en diciembre de 1969, y posterior ratificaci\u00f3n en 1973. Firm\u00f3 el Protocolo de San Salvador en 1997, y est\u00e1n vigentes todos los tratados que integran el Sistema Interamericano de Protecci\u00f3n de los Derechos Humanos. A su vez, acepta la competencia de la Corte Interamericana de Derechos Humanos.<\/p>\n
