Establece que las tierras comunales de grupos \u00e9tnicos y las tierras de Resguardos son inalienables, imprescriptibles e inembargables (Art. 63), y que los resguardos ind\u00edgenas son de propiedad colectiva y no enajenable (Art. 239). En su Cap\u00edtulo XIV, el Art. 85 define que en funci\u00f3n de las necesidades de tierras de las comunidades ind\u00edgenas, el Instituto Colombiano de la Reforma Agraria podr\u00e1:<br \/>\u2022 constituir, ampliar y proceder al saneamiento de tierras ocupadas por personas que no pertenezcan a la parcialidad;<br \/>\u2022 reestructurar y ampliar resguardos coloniales con las tierras individuales o colectivas de los miembros de la parcialidad, y los predios adquiridos o donados en favor de la comunidad.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column type=\u00bb1_3&#8243;][et_pb_image _builder_version=\u00bb3.22.5&#8243; z_index_tablet=\u00bb500&#8243;]<\/p>\n<p>\nSe estableci\u00f3 que la entrega de tierras ser\u00eda gratuita a los cabildos o autoridades tradicionales para que las distribuyan equitativamente entre las familias.<br \/>En particular para las zonas de reserva forestal de la Amazon\u00eda y del Pac\u00edfico, hasta 1997 el Instituto Colombiano de la Reforma Agraria deb\u00eda sanear los resguardos ind\u00edgenas, titulaci\u00f3n que deb\u00eda realizarse de acuerdo a las normas de explotaci\u00f3n previstas en el C\u00f3digo Nacional de Recursos Naturales Renovables y de Protecci\u00f3n al Medio Ambiente.<br \/>El mismo art\u00edculo define que los territorios tradicionales de pueblos ind\u00edgenas n\u00f3madas, semin\u00f3madas o agricultores itinerantes para la caza, recolecci\u00f3n u horticultura, en zonas de reserva forestal solo podr\u00e1n destinarse a conformar resguardos ind\u00edgenas; pero su ocupaci\u00f3n y aprovechamiento deber\u00e1 someterse adem\u00e1s, a las prescripciones que establezca el Ministerio del Medio Ambiente y las disposiciones vigentes sobre recursos naturales renovables.<br \/>En el Art. 87 de esta ley se detalla que los resguardos ind\u00edgenas quedan sujetos al cumplimiento de la funci\u00f3n social y ecol\u00f3gica de la propiedad, conforme a los usos, costumbres y cultura de sus integrantes.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row][et_pb_column type=\u00bb1_4&#8243;][et_pb_image _builder_version=\u00bb3.22.5&#8243; z_index_tablet=\u00bb500&#8243;]<\/p>\n<p><strong>Derecho a los Recursos Naturales Renovables:<\/strong> Los recursos naturales renovables son propiedad de las comunidades titulares de los resguardos, quienes tienen derecho a manejarlos de acuerdo a sus usos y costumbres.<\/p>\n<p><strong>Derecho a la Consulta respecto a Recursos No Renovables:<\/strong> de acuerdo a la Constituci\u00f3n, el Estado es propietario del subsuelo y de los recursos naturales no renovables (Art. 332). No obstante, es obligatoria la consulta y concertaci\u00f3n con los pueblos ind\u00edgenas, puesto que el Art. 330 se\u00f1ala que la explotaci\u00f3n de los recursos naturales en los territorios ind\u00edgenas se debe realizar sin desmedro de la integridad cultural, social y econ\u00f3mica de las comunidades ind\u00edgenas. El fallo reconoci\u00f3 el derecho a la Consulta previa a la explotaci\u00f3n de recursos naturales en sus territorios, d\u00e1ndole rango de derecho constitucional (Para leer el Fallo SCC n.\u00ba SU-039\/97 haz click Aqu\u00ed).<\/p>\n<p><strong>Reglamento de Tierras para Ind\u00edgenas<\/strong><br \/>El Decreto N\u00ba 2.164 del 7 de Diciembre de 1995 reglament\u00f3 la Ley 160 en lo relacionado con la dotaci\u00f3n y titulaci\u00f3n de tierras a las comunidades ind\u00edgenas para la constituci\u00f3n, reestructuraci\u00f3n, ampliaci\u00f3n y saneamiento de los Resguardos Ind\u00edgenas en el territorio nacional. Para leer este decreto haz click Aqu\u00ed.<\/p>\n<p><strong>Ley de \u00c1reas Protegidas<\/strong><br \/>El Decreto 662 del a\u00f1o 1997 establece un r\u00e9gimen especial de gobierno para los casos en que se solapan resguardos ind\u00edgenas con \u00e1reas protegidas:<\/p>\n<blockquote>\n<p>\u2022 La declaraci\u00f3n de un parque nacional no es incompatible con la constituci\u00f3n de una reserva ind\u00edgena;<br \/>\u2022 Las \u00e1reas que se solapan con resguardos ind\u00edgenas deben tener un R\u00e9gimen Especial de Manejo, en beneficio de la poblaci\u00f3n ind\u00edgena; y de acuerdo al cual se respetar\u00e1 la permanencia de la comunidad y su derecho al aprovechamiento econ\u00f3mico de los recursos naturales renovables, observando las tecnolog\u00edas compatibles con los objetivos del sistema se\u00f1alado al \u00e1rea respectiva;<br \/>\u2022 El R\u00e9gimen Especial ser\u00e1 establecido por acuerdo entre la Autoridad P\u00fablica de Parques Nacionales, la autoridad p\u00fablica de las Asociaciones de Cabildos y\/o las Autoridades Tradicionales Ind\u00edgenas (AATI) reconocidas por el Ministerio del Interior y de Justicia.<\/p>\n<\/blockquote>\n<p>Hasta el momento existe un s\u00f3lo acuerdo de R\u00e9gimen Especial de Manejo, en el caso del Parque Nacional Cahuinar\u00ed, y para continuar el proceso de establecer otros Reg\u00edmenes especiales es necesario resolver c\u00f3mo se autorizar\u00e1n las actividades econ\u00f3micas en esas \u00e1reas traslapadas. En las \u00c1reas Protegidas la Constituci\u00f3n prohibe las actividades extractivas.<\/p>\n<p><strong>Mesa Regional Amaz\u00f3nica<\/strong><br \/>En el a\u00f1o 2005 por Decreto N\u00ba 3012 se crea la Mesa Regional Amaz\u00f3nica, que a partir del 2007 re\u00fane cada semestre a organizaciones ind\u00edgenas, gobierno y ministerios para discutir las Pol\u00edticas P\u00fablicas y de Desarrollo para la Amazon\u00eda. Actualmente se desarrolla el Proyecto de Ley de Ordenamiento Territorial Ind\u00edgena, articulando sistemas de conocimiento ind\u00edgena y occidental en base a cinco ejes: educaci\u00f3n, salud, medio ambiente, desarrollo socioecon\u00f3mico y gobierno propio.
