\u00abLos gobernadores de los cabildos asumen la representaci\u00f3n hacia afuera <\/em><\/strong>
de la comunidad, en tanto que las autoridades tradicionales -chamanes, <\/strong><\/em>
curacas, taitas y consejos de ancianos- siguen siendo los sabedores del <\/strong><\/em>
conocimiento ancestral, los gu\u00edas espirituales y a quienes se acude para <\/strong><\/em>

La Constituci\u00f3n de Colombia de 1991<\/strong> inaugur\u00f3 el reconocimiento de las propias autoridades, y la posibilidad de gobierno seg\u00fan sus propias normas y procedimientos.
En sus disposiciones sobre organizaci\u00f3n territorial, y siempre dentro de los l\u00edmites de la constituci\u00f3n y las leyes, la Constituci\u00f3n define que las Entidades Territoriales Ind\u00edgenas<\/strong> gozan de Autonom\u00eda para la gesti\u00f3n de sus intereses; y dentro de los l\u00edmites de la constituci\u00f3n tienen derecho a:<\/p>\n

\n

1.<\/strong> Gobernarse por autoridades propias.
2.<\/strong> Ejercer las competencias que les correspondan.
3.<\/strong> Administrar los recursos y establecer los tributos necesarios para el cumplimiento de sus funciones.
4.<\/strong> Participar en las rentas nacionales (Art. 287).<\/p>\n<\/blockquote>\n

Jurisdicci\u00f3n especial:<\/strong> las autoridades de los pueblos ind\u00edgenas podr\u00e1n ejercer funciones jurisdiccionales dentro de su \u00e1mbito territorial, de conformidad con sus propias normas y procedimientos. Estas autoridades funcionar\u00e1n en coordinaci\u00f3n con el Sistema Judicial Nacional (Art. 246).<\/p>\n

Autoridades Propias:<\/strong> las ETI ser\u00e1n gobernadas por Consejos conformados y reglamentados seg\u00fan los usos y costumbres de sus comunidades; que deber\u00e1n velar por la aplicaci\u00f3n de normas de usos del suelo y poblaci\u00f3n; preservar los recursos naturales; dise\u00f1ar pol\u00edticas, planes y programas de desarrollo econ\u00f3mico y social; coordinar los programas y proyectos promovidos por las comunidades en su territorio; promover inversiones p\u00fablicas y velar por su debida ejecuci\u00f3n; percibir y distribuir sus recursos; y representar a los territorios ante el Gobierno Nacional (Art. 330).<\/p>\n

El Reglamento de tierras para ind\u00edgenas<\/strong> (Decreto N\u00ba 2.164 de 1995) define que los Resguardos Ind\u00edgenas ser\u00e1n manejados y administrados por los respectivos cabildos o autoridades tradicionales de las comunidades, de acuerdo a sus usos y costumbres,<\/strong> y a la legislaci\u00f3n especial referida a la materia (Art. 22).
Define a las autoridades tradicionales<\/strong> como los miembros de una comunidad ind\u00edgena que ejercen, dentro de la estructura propia de la respectiva cultura, un poder de organizaci\u00f3n, gobierno, gesti\u00f3n o control social; y a los cabildos como entidades p\u00fablicas especiales, cuyos integrantes son miembros de una comunidad ind\u00edgena, elegidos y reconocidos por \u00e9sta, con una organizaci\u00f3n sociopol\u00edtica tradicional, cuya funci\u00f3n es representar legalmente a la comunidad, ejercer la autoridad y realizar las actividades que les atribuyan las leyes, los usos, las costumbres y el reglamento interno de cada comunidad (Art. 2).
Pero los resguardos no son unidades gubernamentales, sino tipos de propiedad; y en algunos casos su delimitaci\u00f3n geogr\u00e1fica no coincide con la jurisdicci\u00f3n de las autoridades ind\u00edgenas, es decir con la organizaci\u00f3n pol\u00edtica de cada pueblo. Incluso existen grandes resguardos al interior de los cuales existen varias autoridades ind\u00edgenas (Biviany Rojas).<\/p>\n

Asociaciones de Autoridades Ind\u00edgenas (AATIs)<\/strong><\/p>\n

Actualmente los pueblos ind\u00edgenas de la amazon\u00eda ejercen su gobierno mediante la figura de AATIs, entidades p\u00fablicas organizativas y pol\u00edticas de car\u00e1cter especial que se originaron en el Art\u00edculo 56 transitorio de la Constituci\u00f3n, que dio lugar al dictado de normas para el funcionamiento de los territorios ind\u00edgenas hasta la expedici\u00f3n de la LOOT. Estas normas fueron reglamentadas por el Decreto 1.088 de 1993<\/strong><\/a>, que regula la Creaci\u00f3n de Asociaciones de Cabildos y\/o Autoridades Tradicionales Ind\u00edgenas.<\/p>\n

El decreto se\u00f1ala que para posibilitar la asociaci\u00f3n y participaci\u00f3n de las comunidades ind\u00edgenas, sus autoridades tradicionales o cabildos pueden asociarse en representaci\u00f3n de sus respectivos territorios ind\u00edgenas (Art. 1); gozar de personer\u00eda jur\u00eddica y autonom\u00eda administrativa (Art. 2). El objeto de las AATIs es el de realizar actividades industriales o comerciales y proyectos de salud, educaci\u00f3n y vivienda que promuevan el desarrollo integral de sus comunidades (Art. 3). La autonom\u00eda de los cabildos y autoridades tradicionales no se compromete por pertenecer a una AATI (Art. 4).<\/p>\n

Representaci\u00f3n en el Senado:<\/strong> existe un cupo de dos senadores elegidos en circunscripci\u00f3n nacional especial por comunidades ind\u00edgenas, los que deber\u00e1n haber ejercido previamente un cargo de autoridad tradicional en su comunidad u organizaci\u00f3n ind\u00edgena (Art. 171).<\/p>\n

Es interesante destacar que en los resguardos solo viven ind\u00edgenas. La presencia de colonos no est\u00e1 permitida.<\/p>\n
