Las diez comunidades negras del Alto Guapi sancionaron en el 2012 un Reglamento Interno que establece los principios y la estructura para el gobierno propio, para la administraci\u00f3n del territorio, los recursos naturales, la elaboraci\u00f3n de pol\u00edticas p\u00fablicas y la administraci\u00f3n de justicia en sus territorios<\/strong>.<\/p>\n <\/p>\n I<\/strong>nformaci\u00f3n General<\/strong><\/p>\n El Consejo Comunitario de Alto Guapi, conformado por 10 Comunidades Negras (Caimito, Naranjo, Rosario, Chig\u00fcero, Hojarascal, San Vicente, Santa Clara, San Agust\u00edn, Las Juntas y Balsitas) tiene una poblaci\u00f3n de 2.026 personas, y tiene titulado un territorio de 103.742 has, el cual puede verse en el siguiente mapa. Luego, cada cap\u00edtulo se construy\u00f3 de la siguiente manera:<\/p>\n Cuando todos los cap\u00edtulos estuvieron redactados, se convoc\u00f3 a una Asamblea general<\/strong> en la que participaron m\u00e1s de 100 delegados de las comunidades, quienes volvieron a examinar el documento, y aprobaron el reglamento. Este sistema incluye pr\u00e1cticas ancestrales como la de ser aconsejados por los mayores, y otras definidas por las comunidades en la Asamblea General.<\/p>\n Para la resoluci\u00f3n de conflictos en el territorio, los encargados de ejercer la justicia ser\u00e1n dos Consejeros de Justicia y Convivencia, personas que habitan el territorio y que comparten la cosmovisi\u00f3n de las comunidades. Los consejeros realizar\u00e1n audiencias de protecci\u00f3n y aclaraci\u00f3n de hechos, con procedimientos establecidos en el Reglamento. Su uso est\u00e1 destinado exclusivamente a las personas que lo habitan, y su administraci\u00f3n corresponde al Consejo Comunitario.<\/p>\n Existen lotes de propiedad familiar en los que ancestralmente cultivan, y que no pueden ser vendidos excepto cuando la familia decida no volver a vivir en la comunidad.<\/p>\n Se definen como Lomas de due\u00f1o a porciones territoriales de 200 metros, que son otorgadas a todas las familias del territorio para cultivo. Guapi, siempre que los cambios no afecten los principios de organizaci\u00f3n comunitaria ni el papel de las comunidades en la toma de decisiones.<\/p>\n Es obligaci\u00f3n del Consejo Comunitario implementar el Reglamento, afirmando que:<\/p>\n \u201cimplementar el reglamento es una tarea de gran importancia para que en el territorio puedan florecer un gobierno, un derecho, una justicia, una convivencia y una multiculturalidad que permita reafirmar, valorar, reconocer y visibilizar a los integrantes de esta parte de la geograf\u00eda en la Rep\u00fablica de Colombia<\/em><\/strong>\u201d.<\/p>\n De esta manera, las comunidades afrocolombianas que habitan gran parte del and\u00e9n territorial del corredor biogeogr\u00e1fico del Choc\u00f3 colombiano han logrado elevar a la categor\u00eda de derecho constitucional la propiedad de los territorios que han habitado ancestralmente.<\/p>\n Actualmente este reglamento est\u00e1 vigente y tanto asesores como comunitarios consideran que es necesario ir ajustando los reglamentos a los nuevos retos propios del contexto, que hay algunas decisiones que se tomaron y que resultan poco practicas por sus costos y, que hay que desarrollar todo un trabajo colectivo en uno de los aspectos m\u00e1s relevantes de la gobernabilidad: la aplicaci\u00f3n de los mecanismos de justicia propia al interior del mismo Desde el a\u00f1o 2001 el Consejo Comunitario de Alto Guapi (CCAG) y organizaciones aliadas (WWF Colombia, Altr\u00f3pico del Ecuador, Corporaci\u00f3n Semillas de Agua y la Corporaci\u00f3n Asesor\u00edas para el Desarrollo (ASDES)) han trabajado juntos para estructurar un Plan de Manejo Territorial y, posteriormente, los Reglamentos Internos del CCAG.<\/p>\n\n
cuidando que se ajustaran a principios legales y que la participaci\u00f3n fuera amplia.<\/li>\n
La tarea de socializaci\u00f3n final se realiz\u00f3 con tres herramientas: un video sobre los reglamentos que se present\u00f3 en visitas a cada comunidad, en las que tambi\u00e9n se compart\u00eda el documento final, y la impresi\u00f3n y env\u00edo del documento impreso \u201cReglamento Interno del CCAG\u201d a cada comunidad.<\/p>\n
