La Constituci\u00f3n de la Rep\u00fablica de Nicaragua de 1987<\/strong>, reformada en 1995, reconoce la multietnicidad y fundament\u00f3 el R\u00e9gimen de Autonom\u00eda para las comunidades ind\u00edgenas y afrodescendientes de la Costa Atl\u00e1ntica (Ley 28). Asimismo, dio lugar a la Ley que desde el a\u00f1o 2003 regula la propiedad de las tierras ind\u00edgenas: Ley 445 de R\u00e9gimen de Propiedad Comunal de las Tierras de los Pueblos Ind\u00edgenas y Comunidades \u00c9tnicas de la Costa Atl\u00e1ntica de Nicaragua y de los R\u00edos Coco, Bocay Indio y Ma\u00edz.<\/p>\n

\u00bfQu\u00e9 instrumentos del Sistema Universal de Derechos Humanos rigen en Nicaragua?<\/strong>
\u2022 Convenio 169 de la OIT
El 7 de Mayo de 2010, el Congreso de Nicaragua aprob\u00f3 el Convenio 169 sobre pueblos ind\u00edgenas y tribales en pa\u00edses independientes, adoptado por la Organizaci\u00f3n Internacional del Trabajo en 1989. Este convenio est\u00e1 vigente desde su ratificaci\u00f3n el 25 de Agosto de 2010, comprometi\u00e9ndose el Estado a dar efecto a las disposiciones del mismo. El Decreto de aprobaci\u00f3n de la Asamblea Nacional N\u00ba 5934 extiende su vigencia a las comunidades afrodescendientes Gar\u00edfunas y Creoles.<\/p>\n

\u2022 Pactos Internacionales de Derechos Econ\u00f3micos, Sociales y Culturales (PIDESC) y de Derechos Civiles y Pol\u00edticos (PIDCP)<\/strong><\/p>\n

Nicaragua adhiere a ambos Pactos y al primer Protocolo Facultativo del PIDCP, desde el 12 de Marzo de 1980. En Febrero de 2009 ratific\u00f3 adem\u00e1s el segundo Protocolo Facultativo del PIDCP. Sin embargo, hasta el momento no ha firmado el Protocolo Facultativo del PIDESC (disponible desde 2008), que permite presentar denuncias sobre la violaci\u00f3n de derechos econ\u00f3micos, sociales y culturales ante Naciones Unidas.<\/p>\n

\u2022 Declaraci\u00f3n de Naciones Unidas sobre Pueblos Ind\u00edgenas<\/strong>
Nicaragua fue uno de los pa\u00edses impulsores de la Declaraci\u00f3n de las Naciones Unidas sobre los Derechos de los Pueblos Ind\u00edgenas, y el 11 de Marzo de 2008, la Asamblea de la Rep\u00fablica aprob\u00f3 con amplia mayor\u00eda la Resoluci\u00f3n No. 001-2008, comprometi\u00e9ndose a \u201cimpulsar acciones que retomen las premisas jur\u00eddicas de la Declaraci\u00f3n para adecuar los marcos normativos nacionales\u201d.<\/p>\n

\nNicaragua es parte de la Convenci\u00f3n Americana de Derechos Humanos (CADH) desde su firma el 11 de Noviembre de 1969, y posterior ratificaci\u00f3n en 1979. Firm\u00f3 el Protocolo de San Salvador en 1988, y est\u00e1n vigentes todos los tratados que integran el Sistema Interamericano de Protecci\u00f3n de los Derechos Humanos. A su vez, reconoce la competencia de la Corte Interamericana de Derechos Humanos.<\/p>\n
