As\u00ed mismo, incluye el mandato de sancionar una Ley sobre el r\u00e9gimen de propiedad de las tierras de las comunidades ind\u00edgenas (Art. 107). De acuerdo a ese mandato, en el a\u00f1o 2003 se sancion\u00f3 la Ley 445, que es el instrumento legal espec\u00edfico de la demarcaci\u00f3n y titulaci\u00f3n de las tierras de los pueblos ind\u00edgenas.<br \/>La Constituci\u00f3n establece que las tierras comunales no se pueden gravar y son inembargables, inalienables e imprescriptibles.<\/p>\n<p><strong>Ley 445: R\u00e9gimen de Propiedad Comunal de las Tierras de los Pueblos Ind\u00edgenas y Comunidades \u00c9tnicas de la Costa Atl\u00e1ntica de Nicaragua y de los R\u00edos Coco, Bocay Indio y Ma\u00edz<\/strong><br \/>La Ley 445 tiene por objetivo la demarcaci\u00f3n y titulaci\u00f3n de territorios para garantizar el derecho a la propiedad, uso, administraci\u00f3n y manejo de sus tierras y recursos naturales. Este concepto comprende las tierras habitadas por la comunidad y aquellas que constituyen el \u00e1mbito tradicional de sus actividades sociales, econ\u00f3micas, culturales, lugares sagrados, \u00e1reas boscosas para reproducci\u00f3n y multiplicaci\u00f3n de flora y fauna, construcci\u00f3n de embarcaciones, as\u00ed como actividades de subsistencia, incluyendo la caza, pesca- y agricultura.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column type=\u00bb1_2&#8243;][et_pb_image _builder_version=\u00bb3.22.5&#8243; z_index_tablet=\u00bb500&#8243;]<\/p>\n<p>Esta Ley crea la Comisi\u00f3n Nacional de Demarcaci\u00f3n y Titulaci\u00f3n (CONADETI), con participaci\u00f3n ind\u00edgena y de funcionarios estatales, y establece el Procedimiento para la titulaci\u00f3n, en cinco etapas.<\/p>\n<p>[\/et_pb_text][et_pb_cta _builder_version=\u00bb3.22.5&#8243; z_index_tablet=\u00bb500&#8243;]<\/p>\n<h4 style=\"text-align: center;\"><strong>Etapas del Procedimiento de titulaci\u00f3n<\/strong><\/h4>\n<p><strong>1. Presentaci\u00f3n de solicitud por parte de las Comunidades:<\/strong> incluyendo un diagn\u00f3stico demogr\u00e1fico, socioecon\u00f3mico y cultural de los solicitantes, sus antecedentes hist\u00f3ricos, las formas tradicionales de manejo y tenencia, y los eventuales conflictos con terceros o comunidades vecinas.<\/p>\n<p><strong>2. Soluci\u00f3n de conflictos:<\/strong> etapa de di\u00e1logo y concertaci\u00f3n por parte de las comunidades y las otras partes involucradas.<\/p>\n<p><strong>3. Medici\u00f3n y Amojonamiento:<\/strong> el Estado, por medio de la Comisi\u00f3n Intersectorial de Demarcaci\u00f3n y Titulaci\u00f3n (CIDT) correspondiente, es responsable del deslinde y amojonamiento en una plazo de 12 meses.<\/p>\n<p><strong>4. Titulaci\u00f3n:<\/strong> la CONADETI debe extender el t\u00edtulo en un plazo de 45 d\u00edas, y en forma gratuita.<\/p>\n<p><strong>5. Ahora las comunidades son due\u00f1as de los recursos. Son due\u00f1os del subsuelo<\/em>.\u201d<br \/>Director de la CIDT.<\/p>\n<p>La Ley 445 expresa que las autoridades municipales deben respetar los derechos de propiedad comunal a las tierras y a los recursos naturales que en ella se encuentran (Art. 11); y que en caso de que el Gobierno Central otorgue concesiones y contratos de explotaci\u00f3n racional de los recursos naturales del subsuelo en tierras ind\u00edgenas, la municipalidad emitir\u00e1 su opini\u00f3n, previa consulta con la comunidad ind\u00edgena en cuyas tierras se encuentren ubicados los recursos naturales; la que no agotar\u00e1 el requisito para el Consejo Regional, o cualquier entidad, de consultar directamente a las comunidades en materia de explotaci\u00f3n de los recursos naturales (Art.12).<\/p>\n<p>[\/et_pb_text][et_pb_image _builder_version=\u00bb3.22.5&#8243; src=\u00bbhttps:\/\/territorioindigenaygobernanza.com\/web\/wp-content\/uploads\/2019\/04\/footer.jpg\u00bb z_index_tablet=\u00bb500&#8243; \/][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p><div class=\"et_pb_row et_pb_row_0 et_pb_row_empty\">\n\t\t\t\t\n\t\t\t\t\n\t\t\t\t\n\t\t\t<\/div> La Constituci\u00f3n Nacional de Nicaragua de 1987, reconoce la existencia de los pueblos ind\u00edgenas, y sus derechos a mantener las formas comunales de propiedad de sus tierras y el goce, uso y disfrute de las mismas (Art. 5).
