La Constituci\u00f3n Nicarag\u00fcense de 1987<\/strong>, fundamenta el R\u00e9gimen de Autonom\u00eda en diferentes art\u00edculos. El Estado reconoce a los pueblos ind\u00edgenas y afrodescendientes, los derechos a:<\/p>\n \u2022 mantener y desarrollar su identidad y cultura, para lo cual el Estado deber\u00e1 garantiza la preservaci\u00f3n de sus culturas y lenguas, religiones y costumbres; Espec\u00edficamente para las Comunidades ind\u00edgenas y afrodescendientes de la Costa Atl\u00e1ntica establece un R\u00e9gimen de Autonom\u00eda particular (Art. 5 y 181), reglamentado mediante Ley 28 de 1987, que establece el Estatuto de Autonom\u00eda de las Comunidades de la Costa Atl\u00e1ntica.<\/strong><\/p>\n Ley 28: Estatuto de Autonom\u00eda de las Comunidades de la Costa Atl\u00e1ntica de Nicaragua<\/strong><\/p>\n La Ley reglamenta el R\u00e9gimen de Autonom\u00eda de las Regiones en donde habitan las Comunidades de la Costa Atl\u00e1ntica (Art. 4), estableciendo dos regiones en el Departamento de Zelaya: la Regi\u00f3n Aut\u00f3noma Atl\u00e1ntico Norte (RAAN) con sede administrativa en la ciudad de Puerto Cabezas; y la Regi\u00f3n Aut\u00f3noma Atl\u00e1ntico Sur (RAAS) con sede administrativa en la ciudad de Bluefields (Art. 6).<\/p>\n Cada Regi\u00f3n tendr\u00e1 personer\u00eda jur\u00eddica de Derecho Publico (Art. 8), y se dividir\u00e1 administrativamente en municipios, conforme a sus tradiciones comunales, y organizados en un Consejo Regional (Art. 7) que tendr\u00e1 las siguientes atribuciones:<\/p>\n \u2022 Participar en la elaboraci\u00f3n y ejecuci\u00f3n de planes y programas de desarrollo en su regi\u00f3n, e impulsar proyectos econ\u00f3micos, sociales y culturales propios. El Estatuto expresa que los habitantes de las Comunidades de la Costa Atl\u00e1ntica tienen derecho a desarrollar libremente sus organizaciones sociales y productivas conforme a sus propios valores, y a elegir y ser elegidos autoridades propias de las Regiones Aut\u00f3nomas (Art. 11). Establece adem\u00e1s que los Consejos son \u201cla autoridad m\u00e1xima\u201d, mientras que las autoridades municipales y comunales forman parte de la administraci\u00f3n regional.<\/p>\n Para garantizar la participaci\u00f3n democr\u00e1tica de todas las etnias de cada regi\u00f3n, la ley obliga a que en los consejos regionales y en su respectiva junta directiva, est\u00e9n representadas todas las comunidades \u00e9tnicas. Cada comunidad define sus Autoridades Comunales Tradicionales<\/strong>, seg\u00fan sus costumbres y tradiciones, para que los represente y los gobierne, tales como S\u00edndico, Wihta, Coordinador u otros, y \u00e9stos podr\u00e1n otorgar autorizaciones para el aprovechamiento de las tierras comunales de los recursos naturales a favor de terceros, siempre cuando sean mandados expresamente para ello por la Asamblea Comunal (Art. 4, 6, 10).<\/p>\n Las autoridades intercomunales, o Autoridades Territoriales<\/strong>, ser\u00e1n electas en Asamblea de Autoridades Comunales de una unidad territorial (Art. 5). \u2022 Promover el racional uso, goce y disfrute de las aguas, bosques, tierras comunales y la defensa de su sistema ecol\u00f3gico.
\u2022 Promover las culturas tradicionales.
\u2022 Promover la articulaci\u00f3n del mercado intrarregional e interregional.
\u2022 Establecer impuestos regionales conforme las leyes que rigen la materia (Art. 8).<\/p>\n
La Ley 28 se centra en el concepto de Autonom\u00eda Regional. Pero posteriormente, surge un proceso de reivindicaci\u00f3n de la Autonom\u00eda Ind\u00edgena, que se ve plasmado en la Ley 445 del a\u00f1o 2003.<\/p>\n
