\nLa Constituci\u00f3n Pol\u00edtica de Honduras reconoce legalmente a las comunidades ind\u00edgenas, y la obligaci\u00f3n del Estado de \u201cdictar medidas de protecci\u00f3n de los derechos e intereses de las comunidades ind\u00edgenas existentes en el pa\u00eds, especialmente de las tierras y bosques donde estuvieren asentadas\u201d (Art. 346). Este es el \u00fanico art\u00edculo de la constituci\u00f3n que hace referencia a su derecho al territorio, y no hace menci\u00f3n alguna a la autonom\u00eda o el derecho a sus formas propias de gobierno.<\/p>\n

Fue ratificado por Honduras en Marzo de 1995, con rango superior a las leyes nacionales. El mismo contin\u00faa vigente, as\u00ed como las resoluciones de los comit\u00e9s de quejas de la OIT sobre el cumplimiento del Convenio.

\nPactos Internacionales de Derechos Econ\u00f3micos, Sociales y Culturales (PIDESC) y de Derechos Civiles y Pol\u00edticos (PIDCP)<\/p>\n

Honduras adhiere a ambos tratados el 19 de Diciembre de 1966. Pero no ha firmado el Protocolo Facultativo del PIDESC (disponible desde 2008), por lo que no da lugar a la presentaci\u00f3n de denuncias sobre la violaci\u00f3n de derechos econ\u00f3micos, sociales y culturales ante Naciones Unidas.<\/p>\n

Honduras firm\u00f3 la Convenci\u00f3n Americana de Derechos Humanos<\/strong> (CADH) en 1969, y la ratific\u00f3 en 1977. En Septiembre de 1981, reconoci\u00f3 la competencia de la Comisi\u00f3n Interamericana de Derechos Humanos, y la jurisdicci\u00f3n y competencia de la Corte Interamericana de Derechos Humanos en Honduras.<\/p>\n

Con respecto al Protocolo de San Salvador<\/strong> sobre Derechos Econ\u00f3micos, Sociales y Culturales, a pesar de que es un instrumento que data de 1988, Honduras ha adherido al mismo reci\u00e9n en el a\u00f1o 2011 .<\/p>\n
