La Constituci\u00f3n Nacional hace una \u00fanica menci\u00f3n a la protecci\u00f3n de los derechos e intereses de las comunidades ind\u00edgenas, \u201cespecialmente de las tierras y bosques donde estuvieren asentadas\u201d (Art. 346).<\/p>\n
En 1992, la Ley de Municipalidades<\/strong> estableci\u00f3 el Municipio como estructura b\u00e1sica territorial del Estado. El pueblo Garifuna apel\u00f3 ante la Corte Interamericana de Derechos Humanos (CIDH) demandando sus t\u00edtulos comunitarios. En consecuencia, hasta la actualidad las comunidades de Triunfo de la Cruz y San Juan Tela se encuentran protegidas por medidas cautelares de la CIDH.<\/p>\n En el a\u00f1o 2004 se sancion\u00f3 la Ley de Propiedad<\/strong>. En su Cap\u00edtulo III. Proceso de Regularizaci\u00f3n de la Propiedad Inmueble para Pueblos Ind\u00edgenas y Afrohondure\u00f1os, reconoce:<\/p>\n \u2022 El derecho de los pueblos ind\u00edgenas y afrohondure\u00f1os a las tierras que tradicionalmente poseen (Art. 93), estableciendo como forma de titulaci\u00f3n las formas tradicionales de propiedad comunal (Art. 94). La prevalencia de dicho derecho de propiedad de estos pueblos por encima de los t\u00edtulos emitidos a favor de terceros que nunca las hayan pose\u00eddo (Art. 96).<\/p>\n \u2022 El deber del Estado de consultar a estos Pueblos cuando pretenda explotar los recursos naturales en sus territorios, e informar sobre los perjuicios y beneficios antes de autorizar cualquier inspecci\u00f3n o explotaci\u00f3n (Art 95).<\/p>\n En Agosto de 2003, previo a la sanci\u00f3n de la Ley de Propiedad, las organizaciones de los 9 pueblos ind\u00edgenas solicitaron al Estado que cumpla con su deber de realizar procesos de Consulta y Consentimiento Libre, previo e informado con respecto al contenido de esa ley. La Organizaci\u00f3n Fraternal Negra Hondure\u00f1a (OFRANEH) logr\u00f3 que se realice la Consulta en la Comunidad Gar\u00edfuna de Durugubutu, instancia en la que los ind\u00edgenas rechazaron el art\u00edculo 100 de la Ley. A pesar de ello, este art\u00edculo fue incluido sin modificaciones:<\/p>\n \u201cSe declara y reconoce que el r\u00e9gimen comunal de las tierras que tradicionalmente poseen estos pueblos conlleva la inalienabilidad, inembargabilidad e imprescriptibilidad de la misma. Derecho a la consulta de pueblos ind\u00edgenas es violado por el Estado \/denuncia En el a\u00f1o 2009, se trabajaba en el Congreso en un anteproyecto de \u201cLey Ind\u00edgena\u201d. El mismo fue analizado por las organizaciones ind\u00edgenas que decidieron retirarlo para su reformulaci\u00f3n, ya que identificaron limitaciones a sus derechos. Ese mismo a\u00f1o, el Congreso autoriz\u00f3 al menos 50 decretos autorizando la construcci\u00f3n de represas hidroel\u00e9ctricas en territorios ind\u00edgenas.<\/p>\n En Enero de 2010, el Congreso Nacional aprob\u00f3 en \u201cPlan Naci\u00f3n 2010-2022\u201d sin consultar a los Pueblos Ind\u00edgenas, a pesar de que su ejecuci\u00f3n comprende territorios de esos pueblos.
