Panam\u00e1 es pionero en Am\u00e9rica Latina en el reconocimiento del derecho territorial ind\u00edgena<\/strong>. Este proceso se remonta a 1870, cuando este pa\u00eds era a\u00fan un departamento perteneciente a Colombia. En ese entonces, el territorio Kuna Yala fue reconocido como Comarca Ind\u00edgena Colombiana. En 1903 Panam\u00e1 se separa de Colombia, y el territorio Kuna queda dividido por las fronteras nacionales.<\/p>\n La primera Constituci\u00f3n de 1904 reconoc\u00eda los derechos de propiedad colectiva de las poblaciones ind\u00edgenas, aunque otorgaba el control de las mismas a misiones cristianas y otros patrones no ind\u00edgenas. Por aquel entonces, el gobierno de Panam\u00e1 desconoci\u00f3 la comarca Kuna de Panam\u00e1; hecho que sumado a las concesiones bananeras, las empresas extractivas de caucho y minerales, la prohibici\u00f3n de sus costumbres por ley, y los abusos de autoridades, motiv\u00f3 el levantamiento en armas de los Kuna, conocido como revoluci\u00f3n de 1925.<\/p>\n z_index_tablet=\u00bb500″]<\/p>\n Posterior a ello, se firm\u00f3 un Tratado de Paz por el cual los Kuna obtienen su propio territorio demarcado, que en 1930 se convierte en Reserva Kuna; y otorgan al Gobierno el desarrollo de escuelas oficiales en las islas Kuna. Luego de una d\u00e9cada, en 1938, se crea la Comarca San Blas, la cual en 1957 se declara Reserva Ind\u00edgena; y finalmente en 1998 cambia su denominaci\u00f3n a Comarca de Kuna Yala. La Ley N\u00ba 16 promulga la organizaci\u00f3n pol\u00edtica de la Comarca Kuna Yala, en base a sus formas tradicionales de organizaci\u00f3n social, incluyendo su propia jurisdicci\u00f3n. Ese mismo a\u00f1o se crea la segunda Comarca Ind\u00edgena: Ember\u00e1-Wounaan. En los a\u00f1os 1996 y 1997 se titulan las Comarcas Madugand\u00ed y Ng\u00f6be-Bugl\u00e9, y finalmente, en el a\u00f1o 2000 se titula la Comarca Wargand\u00ed.<\/p>\n A partir de entonces, el Estado estableci\u00f3 la pol\u00edtica de no crear m\u00e1s comarcas. Pero varios pueblos no cuentan con territorios titulados y lo siguen demandando: los pueblos Naso Tjerdi, Bri Bri, fracciones de los Ember\u00e1 y Wounaan (en el Dari\u00e9n, Alto Bayano y Chim\u00e1n) y los Kuna de Dakarkunyala.<\/p>\n Las leyes vigentes reconocen el derecho al territorio y la gobernanza de los pueblos ind\u00edgenas, y fijan que las tierras colectivas en las comarcas son inembargables e imprescriptibles. Sin embargo, el Estado Paname\u00f1o se reserva el derecho a intervenir o expropiar \u00e1reas de \u201cprioridad nacional\u201d, y conceder permisos para exploraciones y explotaciones mineras, h\u00eddricas y forestales, que se realizan sin procesos de consulta ni consentimiento por parte de los ind\u00edgenas; y constituyen actualmente amenazas a sus territorios y sus formas de vida (Ej. proyecto hidroel\u00e9ctrico Chan 75).<\/p>\n Recientemente, en el a\u00f1o 2008, fue aprobada la Ley 72 de adjudicaci\u00f3n de la propiedad colectiva de los pueblos ind\u00edgenas que no est\u00e1n dentro de Comarcas.
