La Constituci\u00f3n Nacional de Panam\u00e1<\/strong> (2004) reconoce a las comunidades campesinas e ind\u00edgenas, a quienes establece se otorgar\u00e1 atenci\u00f3n especial con el fin de promover su participaci\u00f3n econ\u00f3mica, social y pol\u00edtica en la vida nacional (Art. 120). Asi mismo, establece la reserva de las tierras y su propiedad colectiva para el bienestar de las comunidades ind\u00edgenas en los siguientes art\u00edculos:<\/p>\n

Derecho a la Propiedad Colectiva de las Tierras:<\/strong> La Ley podr\u00e1 establecer un r\u00e9gimen especial de propiedad colectiva para las comunidades campesinas que lo soliciten. (Art. 122. inc. 1); y establecer medios de comunicaci\u00f3n y transporte para unir las comunidades campesinas e ind\u00edgenas con los centros de almacenamiento distribuci\u00f3n y consumo (Art. 122. inc. 4).<\/p>\n

Sin embargo, con respecto a los Recursos Naturales no Renovables, la Constituci\u00f3n establece que<\/strong> pertenecen al Estado las riquezas del subsuelo, que podr\u00e1n ser explotadas por empresas estatales o mixtas o ser objeto de concesiones (Art. 254), as\u00ed como las concesiones para la explotaci\u00f3n del suelo, del subsuelo, de los bosques y para la utilizaci\u00f3n de agua, de medios de comunicaci\u00f3n o transporte y de otras empresas de servicio p\u00fablico, que se inspirar\u00e1n en el bienestar social y el inter\u00e9s p\u00fablico (Art. 256).<\/p>\n

En Panam\u00e1 existen dos formas de acceso territorial legalmente establecidas:<\/p>\n

A. La ley de Comarcas<\/strong>
Las comarcas ind\u00edgenas implican el reconocimiento de los derechos colectivos sobre la tierra y los derechos de administraci\u00f3n de sus recursos existentes.<\/strong> Las Leyes de creaci\u00f3n de las 5 Comarcas de Panam\u00e1 son las siguientes:<\/p>\n

B. Ley de Tierras Colectivas<\/strong>
La Ley 72 (2008) establece el procedimiento para la Adjudicaci\u00f3n Gratuita de la propiedad colectiva de tierras tradicionalmente ocupadas por los pueblos y comunidades ind\u00edgenas que no est\u00e1n dentro de Comarcas.<\/p>\n

El procedimiento se inicia con la presentaci\u00f3n de una Solicitud por parte de las comunidades y pueblos ind\u00edgenas, junto a un croquis o plano y la certificaci\u00f3n de un censo poblacional de la comunidad. ante la Direcci\u00f3n Nacional de Reforma Agraria del Ministerio del Desarrollo Agropecuario, que otorgar\u00e1 con prontitud y prioridad a la comunidad el respectivo t\u00edtulo colectivo, representado en sus respectivas autoridades tradicionales (Art. 3, 4 y 5). Este t\u00edtulo es imprescriptible, intransferible, inembargable e inalienable. (Art 9).<\/p>\n

El Estado destinar\u00e1 los fondos necesarios para la delimitaci\u00f3n de las tierras colectivas que se otorguen en cumplimiento de la presente Ley (art. 16).<\/p>\n

La Ley 72 est\u00e1 reglamentada por el Decreto 223 del 26 de Junio de 2010. El organismo encargado de la implementaci\u00f3n de la ley es la Direcci\u00f3n Nacional de Tierras Ind\u00edgenas, direcci\u00f3n operativa de la Autoridad Nacional de Administraci\u00f3n de Tierras (ANATI).<\/p>\n

Se puede concluir que esta ley permite la titulaci\u00f3n de Tierras Colectivas. Sin embargo, no existe ning\u00fan titulo otorgado en el marco de esta ley, puesto que a\u00fan no se ha implementado. La mayor\u00eda de las comunidades Ember\u00e1 y Wounaan en el Dari\u00e9n son llamadas por ellos \u201cTierras Colectivas\u201d; pero no est\u00e1n legalmente tituladas a los ind\u00edgenas, sino que al quedar fuera de las Comarcas, se consideran hasta la actualidad como tierras nacionales, al igual que los territorios tradicionales de los darienitas.<\/p>\n

Los territorios que se encuentran en este proceso de titulaci\u00f3n son:<\/strong>
– Tierras Colectivas Ember\u00e1 Wounaan del Dari\u00e9n
– Territorio Ember\u00e1 de Alto Bayano
– Congreso Nacional Wounaan en Chiman
– Tierras Colectivas de Dagarkunayala, cercanas a la frontera con Colombia
– Tierras Colectivas Bri Bri.<\/p>\n

La Ley 72 establece que en caso de que las tierras se encuentren reconocidas como \u00c1reas Protegidas, el uso de los recursos naturales ser\u00e1 coordinado entre las autoridades ind\u00edgenas tradicionales y la Autoridad Nacional del Ambiente (Art. 13).<\/p>\n
