\u201cLa comarca es una divisi\u00f3n pol\u00edtica especial del territorio paname\u00f1o, regida de acuerdo a la ley que la crea y a las normas, costumbres o cosmovisi\u00f3n del\/los pueblo(s) ind\u00edgena(s) que lo habitan, basada en las instituciones tradicionales ind\u00edgenas creadas de acuerdo a sus valores espirituales, sociales, econ\u00f3micos y culturales, jur\u00eddicas y pol\u00edticas, cuya autoridad m\u00e1xima es el Congreso General Ind\u00edgena o Consejo Ind\u00edgena, cuyo representante es el cacique o autoridad tradicional elegido por ellos de acuerdo a su tradici\u00f3n\u201d<\/p>\n

Las comarcas Ind\u00edgenas son la figura territorial geopol\u00edtica que ha predominado desde los a\u00f1os 60-70s. En total existen 5 comarcas ind\u00edgenas otorgadas en Panam\u00e1.<\/p>\n

De acuerdo a la Ley de Comarcas<\/strong>, los derechos colectivos sobre la tierra y los recursos naturales se ejercen a trav\u00e9s de las estructuras tradicionales de administraci\u00f3n, como lo son los Congresos Generales. En esencia, la Ley establece el derecho a la libre determinaci\u00f3n. La propia Constituci\u00f3n Nacional expresa la intenci\u00f3n de impulsar el desarrollo social, econ\u00f3mico y cultural de los pueblos ind\u00edgenas, a trav\u00e9s de sus gobiernos tradicionales<\/p>\n

Actualmente, dado el fallo de la Corte Suprema de Justicia del 23 de marzo de 2001, las Comarcas tienen una organizaci\u00f3n pol\u00edtico-administrativa distinta e independiente<\/strong> a la de los Distritos y Corregimientos. Las Comarcas se rigen de acuerdo a instituciones especiales propias;<\/strong> y seg\u00fan resoluci\u00f3n de Sala Tercera de la Corte Suprema de Justicia, del d\u00eda 6 de diciembre de 2000, una de las instituciones es el consentimiento de los pueblos ind\u00edgenas en los proyectos que pretendan desarrollarse en sus territorios.<\/p>\n

Cada Comarca es establecida mediante una Ley aprobada por la asamblea Nacional de Diputados. Cada una de estas Leyes es reglamentada a trav\u00e9s de un Decreto que reconoce o adopta su carta org\u00e1nica o estatuto. Los Estatutos de las Comarcas son:<\/p>\n

Desde el a\u00f1o 2008, La Ley 72<\/strong> establece el reconocimiento de las formas tradicionales de organizaci\u00f3n, la cultura y las autoridades de los pueblos ind\u00edgenas titulares de la propiedad colectiva de tierras,<\/strong> y que el \u00d3rgano Ejecutivo, por medio del Ministerio de Gobierno y Justicia establecer\u00e1 procedimientos para la coordinaci\u00f3n entre \u00e9stas y las autoridades nacionales electas o designadas (Art. 15).<\/strong><\/p>\n

\nEn la misma se define que ese Ministerio adopta la Carta Org\u00e1nica del Corregimiento Ind\u00edgena Comarcal Teribe del Distrito de Changuinola en la provincia de Bocas del Toro (Art. 17). En relaci\u00f3n a este \u00faltimo art\u00edculo, los grupos Naso-Tjerdi reunidos en el Congreso General Naso, as\u00ed como el Congreso General Kuna (Comarca Kuna-Yala) rechazaron esta Ley, afirmando que el Art\u00edculo 17 facilitar\u00eda las concesiones hidroel\u00e9cticas y mineras en territorio tradicional Naso Tjerdi.<\/p>\n
