\u201cSe debe ratificar un derecho preexistente. Esta es una nota clave. No existe cesi\u00f3n de derechos por parte del Estado, sino reconocimiento de la continuidad hist\u00f3rica del derecho.<\/strong> Pedro Garc\u00eda (2010)<\/p>\n La Constituci\u00f3n Nacional de 1993<\/strong><\/a> en su Cap\u00edtulo VI sobre el R\u00e9gimen Agrario y de las Comunidades Campesinas y Nativas, establece que el Estado apoya preferentemente el desarrollo agrario, garantizando la propiedad privada o comunal de la tierra, que cuando son abandonadas pasan a ser de dominio del Estado para su adjudicaci\u00f3n en venta (Art. 88); y que el Estado respeta la identidad cultural de las Comunidades Campesinas y Nativas.<\/p>\n De acuerdo a la Constituci\u00f3n, las Comunidades Nativas<\/strong> son personas jur\u00eddicas, aut\u00f3nomas en su organizaci\u00f3n, trabajo comunal y en el uso y la libre disposici\u00f3n de sus tierras, as\u00ed como en lo econ\u00f3mico y administrativo, dentro del marco que la ley establece. La propiedad de sus tierras es imprescriptible, salvo en el caso de abandono (Art. 89). Ley 26834 de \u00c1reas Naturales Protegidas (1996)<\/strong>

Esta Ley (que puedes descargar Aqu\u00ed) define las Reservas Comunales como \u00e1reas destinadas a la conservaci\u00f3n de la flora y la fauna silvestre, en beneficio de las poblaciones rurales vecinas (Art. 22). Bajo esa figura fueron designadas las reservas comunales Yanesha, Ash\u00e1ninka, Machiguenga, Sira y Amarakaeri, Tamshiyacu-Tahuayo. La propiedad de esos territorios pertenece al Estado.
