\nLa Constituci\u00f3n Nacional de 1993 en su Art. 191 establece que los gobiernos regionales tienen autonom\u00eda pol\u00edtica, econ\u00f3mica y administrativa en los asuntos de su competencia; y que La ley establece porcentajes m\u00ednimos para hacer accesible la representaci\u00f3n de g\u00e9nero, comunidades campesinas y nativas, y pueblos originarios en los Consejos Regionales y Municipales.<\/p>\n

En el Art. 149, define que las Autoridades de las Comunidades Campesinas y Nativas, con el apoyo de las Rondas Campesinas, pueden ejercer las funciones jurisdiccionales dentro de su \u00e1mbito territorial de conformidad con el derecho consuetudinario, siempre que no violen los derechos fundamentales de la persona. La ley establece las formas de coordinaci\u00f3n de dicha jurisdicci\u00f3n especial con los Juzgados de Paz y con las dem\u00e1s instancias del Poder Judicial.<\/p>\n

Ley de \u00c1reas Protegidas<\/strong>
Reconoce el uso y estilos de vida tradicional y la autodeterminaci\u00f3n de comunidades nativas y campesinas, pero \u00fanicamente \u201csi los usos son compatibles con los objetivos de las \u00e1reas protegidas\u201d. El Reglamento de la Ley expl\u00edcitamente reconoce que la Convenci\u00f3n OIT 169 sobre Pueblos Ind\u00edgenas y Tribales, de acuerdo a lo cual los pueblos ind\u00edgenas tienen el derecho a \u201cdecidir sus propias prioridades para el proceso de desarrollo mientras afecte sus vidas, creencias, instituciones y bienestar espiritual y las tierras que ocupan o utilizan, y para ejercer control, al punto posible, sobre su propio desarrollo econ\u00f3mico, social y cultural\u201d, pero nuevamente queda en las resoluciones generales del reglamento un punto calificador de que el uso debe estar \u201cen armon\u00eda con los objetivos por los cuales se crearon las \u00c1reas Protegidas\u201d.<\/p>\n

R\u00e9gimen Especial de Administraci\u00f3n de Reservas Comunales<\/strong><\/p>\n

Establece para las Reservas Comunales de car\u00e1cter permanente o indefinido, que los encargados de su administraci\u00f3n son los mismos beneficiarios (Art 2), quienes se conforman como \u201cEjecutor\u201d al conformar una persona jur\u00eddica sin fines de lucro que puede ser multicomunal e intercultural (Art 13).<\/p>\n

Reconoce a los Presidentes, Jefes, Apus y autoridades tradicionales de los pueblos ind\u00edgenas, como representantes directos de los beneficiarios, con derecho a formar parte de la Asamblea General del Ejecutor del Contrato de Administraci\u00f3n (Art 14).<\/p>\n

El Contrato de Administraci\u00f3n es de duraci\u00f3n permanente o indefinida, y sus beneficiarios son encargados de las funciones de administraci\u00f3n y manejo de la Reserva Comunal establecidas en la legislaci\u00f3n de \u00c1reas Nacionales Protegidas y en el Plan Maestro de la Reserva Comunal (Art 19).<\/p>\n

La Ley establece adem\u00e1s el proceso de designaci\u00f3n y funciones del Jefe de la Reserva Comunal (Art. 35 a 37), y del Comit\u00e9 de Gesti\u00f3n de las Reservas Comunales (ARt. 38 a 43).<\/p>\n

Derecho a la Consulta<\/strong><\/p>\n

El 23 de Agosto de 2011, el Congreso de la Rep\u00fablica sancion\u00f3 la Ley de Derecho a la Consulta Previa a los Pueblos Ind\u00edgenas u Originarios reconocido en el Convenio N\u00ba 169 de la Organizaci\u00f3n Internacional del Trabajo [1]. La misma define su derecho a ser consultados en forma previa sobre las medidas legislativas y administrativas, programas y proyectos de desarrollo nacional y regional, que afecten directamente sus derechos colectivos, su existencia f\u00edsica, identidad cultural, calidad de vida o desarrollo. La implementaci\u00f3n de la Consulta es implementada de forma obligatoria s\u00f3lo por el estado (Art. 2). La finalidad de la consulta es alcanzar un acuerdo o consentimiento entre el Estado y los pueblos ind\u00edgenas, a trav\u00e9s de un di\u00e1logo intercultural que garantice su inclusi\u00f3n en los procesos de toma de decisi\u00f3n del Estado y la adopci\u00f3n de medidas respetuosos de sus derechos colectivos (Art. 3).<\/p>\n

La consulta debe ser previa, adaptarse a las diferencias entre las culturas, realizarse de buena f\u00e9 estando prohibidas las conductas antidemocr\u00e1ticas, el proselitismo partidario y la coacci\u00f3n o condicionamiento; y realizarse en un plazo razonable para que los pueblos reflexionen sobre el objeto de la consulta (Art. 4).<\/p>\n

De acuerdo al Art. 8 de la Ley, el Procedimiento de la Consulta es el siguiente:<\/p>\n

a) Identificaci\u00f3n de las medidas legislativas o administrativas que deben ser objeto de consulta:<\/strong> tanto por parte de las entidades estatales como por parte de las organizaciones ind\u00edgenas (Art. 9).<\/p>\n

b) Identificaci\u00f3n de los pueblos ind\u00edgenas a ser consultados:<\/strong> por parte de las entidades estatales promotoras de la medida (Art. 10).<\/p>\n

c) Publicidad de la medida legislativa o administrativa:<\/strong> las entidades estatales deben ponerla en conocimiento de las organizaciones ind\u00edgenas, mediante m\u00e9todos culturalmente adecuados (Art. 11).<\/p>\n

d) Informaci\u00f3n sobre la medida legislativa o administrativa:<\/strong> acerca de los motivos, implicancias, impactos y consecuencias de la medida (Art. 12).<\/p>\n

e) Evaluaci\u00f3n interna en las organizaciones de los pueblos ind\u00edgenas sobre las medidas legislativas o administrativas que les afecten directamente.<\/strong><\/p>\n

f) Proceso de di\u00e1logo entre representantes del Estado y representantes de los pueblos ind\u00edgenas:<\/strong> en el cual los pueblos ind\u00edgenas pueden expresar sus opiniones y propuestas que deben quedar registradas en acta (Art. 14).<\/p>\n

g) Decisi\u00f3n:<\/strong> la aprobaci\u00f3n de la medida es decisi\u00f3n final de la entidad estatal competente, debidamente motivada, y evaluando los puntos de vista, sugerencias y recomendaciones de los pueblos ind\u00edgenas, as\u00ed como el an\u00e1lisis de las consecuencias sobre sus derechos colectivos reconocidos constitucionalmente en los tratados ratificados por el Estado Peruano.<\/p>\n

El acuerdo que resulte del Proceso de Consulta es de car\u00e1cter obligatorio para ambas partes: pueblos ind\u00edgenas y Estado. En caso de no llegar a un acuerdo, las entidades estatales deben adoptar medidas para garantizar los derechos colectivos de los pueblos ind\u00edgenas.<\/strong><\/p>\n
