Los territorios Ember\u00e1 y el Parque Nacional Utr\u00eda en Colombia<\/strong>
Una propuesta de R\u00e9gimen Intercultural de Co-Manejo del \u00c1rea<\/strong><\/p>\n

El Parque Nacional Utr\u00eda propone la construcci\u00f3n de un R\u00e9gimen Intercultural para el Co-Manejo del \u00c1rea Protegida, la cual se superpone con Resguardos Ind\u00edgenas Ember\u00e1 y colinda con tierras de comunidades negras. No obstante, las Organizaciones Ind\u00edgenas Locales reclaman la exclusividad en el manejo y administraci\u00f3n de sus territorios solapados por el Parque.<\/p>\n

Informaci\u00f3n General<\/strong>
El Parque Nacional Natural Utr\u00eda se ubica en los Municipios de Bah\u00eda Solano, Nuqu\u00ed, Alto Baud\u00f3 y Bojay\u00e1, en el Departamento del Choc\u00f3, en Colombia.
La superficie del Parque es de 54.300 has, y equivale a menos de 1 % de la superficie nacional (0.05 %). Su valor est\u00e1 dado por la diversidad y fragilidad de los ecosistemas que contiene: los corales, los manglares, la selva h\u00fameda tropical y el ecosistema marino.<\/p>\n

El Parque colinda con una franja de tierras tituladas a comunidades negras, en las que habitan 280 afrodescendientes.<\/p>\n

La Gobernanza de la Reserva hacia afuera<\/strong>
Actualmente la Reserva es administrada por la Unidad Especial de Parques Nacionales Naturales de Colombia (UAESPNN), dependiente del Ministerio del Medio Ambiente; y se encuentra bajo jurisdicci\u00f3n de la Corporaci\u00f3n Aut\u00f3noma Regional para el Desarrollo Sostenible del Choc\u00f3 (CODECHOC\u00d3).
En el Plan de Manejo del Parque Utr\u00eda para el per\u00edodo 2009-201 La UAESPNN plantea como objetivos tanto la conservaci\u00f3n de ecosistemas, como la conservaci\u00f3n de valores culturales de la Etnia Ember\u00e1 y las comunidades negras de la zona. Por tal motivo, se ha creado una Mesa de Concertaci\u00f3n entre los pueblos ind\u00edgenas y el PNN Utr\u00eda orientada a la propuesta de un R\u00e9gimen Intercultural de Manejo del \u00c1rea.<\/p>\n

La Propuesta de R\u00e9gimen Intercultural de Manejo del Parque Nacional Utr\u00eda<\/strong>
Esta propuesta se fundamenta en el reconocimiento de que los conocimientos y pr\u00e1cticas ancestrales han conservado la biodiversidad, y que el ordenamiento territorial ind\u00edgena puede ser una oportunidad para el alcance de objetivos comunes.
El eje de la propuesta es el co-manejo del Parque a partir de la formulaci\u00f3n de Planes de Vida ind\u00edgena de los Ember\u00e1, en consonancia con la conservaci\u00f3n ambiental. Estos Planes tendr\u00edan 4 temas centrales:<\/p>\n

* El Ordenamiento Ambiental Ind\u00edgena en la zona traslapada.
* El Ordenamiento de la pesca en el \u00e1rea marino-costera.
* El Ordenamiento del ecoturismo en la zona continental no traslapada y en el \u00e1rea de la Ensenada.
* El An\u00e1lisis de la din\u00e1mica regional, orientado hacia los poblados negros vecinos en la zona de amortiguamiento.<\/p>\n

En los planes de Manejo, se definir\u00edan \u00e1reas de preservaci\u00f3n, \u00e1reas de recuperaci\u00f3n tradicional, \u00e1reas de agricultura tradicional, \u00e1reas de investigaci\u00f3n, y \u00e1reas de cacer\u00eda y extracci\u00f3n: para cada una se estipulan cu\u00e1les son las actividades permitidas y cu\u00e1les las prohibidas, como se ve en el siguiente cuadro:<\/p>\n

No obstante, la postura de las Organizaciones Ind\u00edgenas Locales es otra, diferente a la del co-manejo.<\/strong>
La Federaci\u00f3n de Organizaciones Ember\u00e1 Wounaan (FEDEOREWA), y el Consejo Regional Ind\u00edgena del Choc\u00f3 (CRICH), ambos integrantes de la Organizaci\u00f3n Nacional Ind\u00edgena de Colombia (ONIC), reclaman su derecho al autogobierno y a la exclusividad en el manejo y la administraci\u00f3n de sus territorios. En reiteradas ocasiones han cuestionado que la administraci\u00f3n actual del Parque gestione recursos econ\u00f3micos a nombre de las comunidades, sin que \u00e9stas puedan controlar los mismos; y que se lleven a cabo investigaciones sin dar participaci\u00f3n a las comunidades en su realizaci\u00f3n y en sus beneficios.
En el territorio afrocolombiano que colinda con el Parque Utr\u00eda, la autoridad local es el Consejo Comunitario \u201cEl Cedro\u201d, con quienes la administraci\u00f3n del Parque Utr\u00eda ha iniciado la elaboraci\u00f3n de Planes de Manejo de la Zona de Amortiguamiento.<\/p>\n

Gobernanza Interna<\/strong>
Las autoridades ind\u00edgenas de los Ember\u00e1, los jaiban\u00e1s, son tradicionalmente los encargados de definir las \u00e1reas de reserva para garantizar la reproducci\u00f3n de la fauna, y las actividades agr\u00edcolas rotativas, pecuarias, de caza, recolecci\u00f3n; y de definir la protecci\u00f3n de las \u00e1reas sagradas. Adem\u00e1s de ser l\u00edderes espirituales, son los conocedores de la naturaleza y de la medicina tradicional.
Los Ember\u00e1 defienden el ejercicio de su gobierno propio, como qued\u00f3 reflejado en los mandatos del Primer Congreso Nacional del Pueblo Ember\u00e1 realizado en el a\u00f1o 2006:<\/p>\n

\u201cTodo ind\u00edgena que venda las tierras a colonos o negocie los recursos naturales renovables y no renovables de los territorios ind\u00edgenas ser\u00e1 sancionado en ejercicio de la justicia propia por las autoridades ind\u00edgenas locales o regionales.\u201d<\/em><\/p>\n

\u201cFortalecer la medicina tradicional a trav\u00e9s de la implementaci\u00f3n de bancos de semillas y huertas tradicionales, creando una escuela Ember\u00e1 en el conocimiento y manejo de las plantas tradicionales, con la ense\u00f1anza de los mayores y Jaiban\u00e1s.<\/em>\u201d<\/p>\n

En el Segundo Congreso Nacional del Pueblo Ember\u00e1 en 2010, se reafirmaron esos mandatos y se decidi\u00f3 exigir al gobierno nacional que no implemente ninguna iniciativa legislativa sobre recursos naturales en territorios de la Naci\u00f3n Ember\u00e1 sin consulta previa y concertaci\u00f3n.<\/p>\n

En conclusi\u00f3n…<\/strong>
Las autoridades del Parque consideran que la implementaci\u00f3n de Planes de Vida Ind\u00edgena y Planes de Manejo de los Territorios de Comunidades Negras de la zona de influencia del Parque, son la base para el logro de los objetivos de conservaci\u00f3n. La propuesta de articular el manejo del Parque con los Planes de Vida Ind\u00edgena podr\u00eda ser la base para un manejo intercultural y horizontal entre la administraci\u00f3n del parque y las autoridades ind\u00edgenas.<\/p>\n

No obstante, los derechos de los pueblos ind\u00edgenas en relaci\u00f3n con el territorio y la autonom\u00eda, deben ser el referente jur\u00eddico obligado para definir un modelo de gesti\u00f3n y administraci\u00f3n de los parques naturales, puesto que son las \u00e1reas protegidas las que se traslapan con los territorios ind\u00edgenas, y no al contrario. En la gesti\u00f3n de los territorios deben participar las autoridades ind\u00edgenas locales y las organizaciones zonales y regionales de las que hacen parte. La experiencia del Pil\u00f3n Lajas, a la vez Reserva de la Biosfera y Territorio Ind\u00edgena, es un ejemplo de distintas formas o grados de participaci\u00f3n ind\u00edgena en su co-manejo: desde la participaci\u00f3n en diagn\u00f3sticos de situaci\u00f3n, a la participaci\u00f3n en aspectos operativos, y finalmente en la toma de decisiones. Los territorios Mayagna, Miskitu y la Reserva de bi\u00f3sfera Bosaw\u00e1s en Nicaragua. Hacia la transferencia de su administraci\u00f3n a las organizaciones ind\u00edgenas<\/strong><\/p>\n

Desde su creaci\u00f3n en 1991, la Reserva Bosaw\u00e1s, administrada por el ministerio de Ambiente y Recursos Naturales de Nicaragua, se superpone con los territorios ancestrales de los Mayagna y Miskitu. Actualmente los Mayagna cuentan con los t\u00edtulos de su territorio y han conformado su Gobierno Territorial desde donde trabajan para que el Gobierno Central les transfiera la administraci\u00f3n de la reserva.
