\u00abLos pueblos ind\u00edgenas deben poder determinar sus propios destinos en pie de igualdad con los dem\u00e1s, participar en la toma de las decisiones que les afectan, y estar seguros en sus derechos individuales y colectivos. Todo esto implica la necesidad de mecanismos efectivos de consulta a los pueblos ind\u00edgenas en los procesos de decisi\u00f3n que puedan afectarles en el goce de sus trav\u00e9s de un proceso llamado de Consentimiento Libre, Previo e Informado (CLPI) sobre todas aquellas leyes, proyectos, estrategias u obras que afecten sus territorios y sus vidas.<\/p>\n Los Deben realizarse en un clima sin violencia ni hostigamiento, sin guardias privados de las empresas o de las fuerzas de seguridad p\u00fablicas. Por lo tanto, el proceso debe realizarse durante la fase exploratoria o de planificaci\u00f3n del proyecto, plan o medida, con suficiente antelaci\u00f3n a su ejecuci\u00f3n. Informado?<\/strong> Los Pueblos consultados deben tener la posibilidad de modificar el plan inicial, y los Estados tienen dos deberes importantes: Jur\u00eddicamente, la Corte Interamericana de Derechos Humanos<\/strong> ha fallado a favor del Consentimiento Libre, Previo e Informado cuando se trata de leyes, planes o proyectos que:<\/p>\n La Reglamentaci\u00f3n de los Procesos de Consulta y Consentimiento Libre, Previo e Informado<\/strong> Esta Ley entrar\u00e1 en vigor en Per\u00fa a fines de Noviembre de 2011, y se supone que contribuir\u00e1 a un incremento de la protecci\u00f3n y El proceso de consulta se entiende como un di\u00e1logo de buena fe entre el Estado y un Pueblo o Comunidad Ind\u00edgena, con la finalidad de llegar a un acuerdo o recibir el Consentimiento informado de los Pueblos Ind\u00edgenas para el desarrollo de proyectos u obras que puedan afectar sus vidas, sus territorios y recursos naturales. Durante este proceso, el Estado y las Comunidades deben cooperar para llegar a una decisi\u00f3n consensuada.
A diferencia de la simple consulta, cuyo resultado no es vinculante (obligatorio) para el Estado o la empresa que promueve el proyecto o la obra, el Consentimiento Libre, Previo e Informado tiene car\u00e1cter vinculante.<\/p>\n
La participaci\u00f3n de los pueblos ind\u00edgenas no solo es exigible durante la consulta, sino tambi\u00e9n en todas las instancias de decisi\u00f3n de los proyectos de explotaci\u00f3n de recursos naturales en sus territorios, y durante su dise\u00f1o, licitaci\u00f3n y concesi\u00f3n, hasta su ejecuci\u00f3n y evaluaci\u00f3n (CIDH).<\/p>\n
Siempre que el Estado tome decisiones o medidas que afecten los territorios y recursos naturales de los Pueblos Ind\u00edgenas, o cuando planifique acciones administrativas o legislativas que tienen impacto sobre los derechos e intereses de los Pueblos Ind\u00edgenas.
Es importante considerar que tanto el Convenio 169 como la Declaraci\u00f3n de la ONU, afirman que el objeto de la consulta con los pueblos ind\u00edgenas es obtener su acuerdo o consentimiento.<\/p>\n
El deber de Acomodo:<\/strong> es el deber de ajustar o incluso cancelar los planes o proyectos en base a los resultados del proceso de Consulta. Cuando no cumple con este deber de acomodo, el Estado debe proporcionar motivos objetivos y razonables para no haberlo hecho.
El deber de Adoptar decisiones razonadas:<\/strong> aunque no todos los procesos de consulta buscan el consentimiento, esto no los reduce a una formalidad. Los Estados deben tener en cuenta las preocupaciones, demandas y propuestas de los Pueblos afectados, y prestar consideraci\u00f3n a las mismas en el dise\u00f1o final del Plan o Proyecto que se consulta.<\/p>\n\n
James Anaya, Relator de Naciones Unidas, asegura que la mayor\u00eda de las Denuncias de los Pueblos Ind\u00edgenas, se\u00f1ala la ausencia de un proceso de consulta o de CLPI cuando se deciden proyectos de desarrollo o el establecimiento de industrias extractivas en sus territorios. Tambi\u00e9n se\u00f1ala que la consulta y el consentimiento libre, previo e informado son elementos centrales para un nuevo modelo de relaciones entre los Estados y los Pueblos ind\u00edgenas.
En general, la ausencia de mecanismos o directrices jur\u00eddicas claras para los procedimientos de Consulta y Consentimiento, obstaculizan el cumplimiento de este deber por parte de los Estados. No obstante, Per\u00fa aprob\u00f3 recientemente la Ley del Derecho a la Consulta Previa a los Pueblos Ind\u00edgenas u Originarios<\/em><\/strong><\/a> reconocido en el Convenio N\u00ba 169 de la Organizaci\u00f3n Internacional del Trabajo. En esta ley:<\/p>\n\n
