De las actividades econ\u00f3micas que se realizan al margen de la ley, tres en particular representan riesgos para los Pueblos Ind\u00edgenas:<\/p>\n

a. El Narcotr\u00e1fico<\/strong><\/h4>\n

El cultivo de coca para producir coca\u00edna es una actividad ilegal que debe diferenciarse del uso ancestral de la coca por los Pueblos Ind\u00edgenas de Bolivia, Per\u00fa y Colombia, donde se emplea por su valor religioso, curativo y alimenticio.<\/p>\n

Por ejemplo en Colombia, de acuerdo a la Oficina de Naciones Unidas contra la Droga y el Delito, el cultivo il\u00edcito de coca abarc\u00f3 68.000 has en el a\u00f1o 2009, de las que el 6.7% correspondi\u00f3 a Resguardos Ind\u00edgenas1, elegidos por el bajo control estatal y el aislamiento. En los resguardos, los narcotraficantes se imponen a los ind\u00edgenas mediante las armas, oblig\u00e1ndolos a participar en el cultivo y transporte de droga, especialmente en zonas fronterizas. Los Pueblos Ind\u00edgenas m\u00e1s afectados por este cultivos il\u00edcito son los Awa, Sikuani, Inga, Embera, Uitoto y Kof\u00e1n en los Resguardos: Predio Putumayo, Chinguirito Mira, San Andr\u00e9s, Las Vegas y Villa Uni\u00f3n, Afilador Campo Alegre, Inga de Wasipanga y Calenturas2.
Mientras la comercializaci\u00f3n de coca\u00edna, lejos de la zona de producci\u00f3n, produce grandes ganancias; el cultivo il\u00edcito de coca y las estrategias para su erradicaci\u00f3n tienen grandes impactos negativos en los Pueblos Ind\u00edgenas.<\/p>\n

La integridad territorial se ve afectada por la militarizaci\u00f3n que ejercen los grupos armados, tanto paramilitares como la guerrilla, que desplazan a las comunidades expropiando sus tierras en forma violenta. Seg\u00fan la Organizaci\u00f3n Nacional Ind\u00edgena Colombiana (ONIC) en el 2010 fueron asesinados 122 ind\u00edgenas, otros 10 desaparecieron y 1.146 fueron forzados a desplazarse como consecuencia del narcotr\u00e1fico.<\/p>\n

La militarizaci\u00f3n de los territorios limita la movilidad de los ind\u00edgenas, muchas veces impidiendo su acceso a alimentos y medicamentos. Las fumigaciones a\u00e9reas con Glifosato, realizadas en el marco del Programa de Erradicaci\u00f3n de Cultivos Il\u00edcitos, destruyen los cultivos alimentarios; incrementando la inseguridad alimentaria.<\/p>\n

La gobernanza en los resguardos se ve afectada por el asesinato de l\u00edderes y autoridades ind\u00edgenas, y por la corrupci\u00f3n de los grupos armados que se convierten en autoridades de facto y controlan las zonas donde operan, debilitando el poder de las autoridades ind\u00edgenas y sus sistemas de justicia propia.<\/p>\n

El cultivo il\u00edcito de coca no s\u00f3lo representa una amenaza a los pueblos ind\u00edgenas de Colombia, donde se encuentra el 50% de la superficie mundial cultivada; sino tambi\u00e9n para los de Per\u00fa y Bolivia, que ostentan el 33 y 17% respectivamente. Secundariamente, se cultiva amapola y cannabis para la elaboraci\u00f3n de hero\u00edna y marihuana, pero en una medida muy inferior al cultivo de coca2.<\/p>\n

b. El Madereo clandestino<\/strong><\/h4>\n

\u201cCuando ha venido este contacto con los madereros, salimos del monte.<\/em><\/strong>
De eso comenz\u00f3 enfermedad\u2026 se muri\u00f3 mi t\u00eda, mi sobrino, se murieron la mitad.<\/em><\/strong>
Los ancianos, los que salieron del monte, no resist\u00edan.<\/em><\/strong>
\u00abSobreviviente Murunahua, luego de ser contactado por madereros ilegales de caoba en Per\u00fa (Survival<\/em>).<\/p>\n

 <\/p>\n

La tala ilegal representa el 80% de la explotaci\u00f3n de madera en la Amazon\u00eda (FAO, 2011) 3,4, pero tambi\u00e9n es importante en Centroam\u00e9rica, por ejemplo en Nicaragua, la ilegalidad alcanza al 70% (FAO, 2005)5.
Esta actividad es realizada por empresas y peque\u00f1os madereros que extraen las especies con mayor valor comercial (como el cedro y la caoba), empobreciendo el bosque y quitando a las comunidades ind\u00edgenas la posibilidad de utilizar esos recursos. Dado el marco de ilegalidad, ocupan los territorios ind\u00edgenas, ingresando muchas veces en forma violenta. En ocasiones, establecen un sistema de endeudamiento y trabajo forzado, que de acuerdo a la Organizaci\u00f3n Internacional del Trabajo, afecta a 33.000 ind\u00edgenas en la Amazon\u00eda Peruana. As\u00ed mismo, se han constatado casos de esclavitud, como el de los Murunahuas (ind\u00edgenas aislados del Per\u00fa), que en 1995 fueron esclavizados por madereros, y liberados en 1998 6, y quienes est\u00e1n siendo obligados a huir de la reserva donde habitan hacia Brasil, por la acci\u00f3n de los madereros ilegales.

c. El Tr\u00e1fico de tierras con t\u00edtulos falsos<\/strong><\/h4>\n

La compra y venta de tierras con t\u00edtulos falsos afecta a miles de familias ind\u00edgenas. Los beneficiarios de este negocio falsifican t\u00edtulos de tierras, expropiadas a campesinos o ind\u00edgenas para acaparar tierras destinadas a proyectos extractivos o agropecuarios; o bien para estafar a compradores que adquieren las tierras de buena f\u00e9, y que luego verifican la nulidad de los t\u00edtulos de propiedad. En algunos casos, especialmente en Colombia, el tr\u00e1fico de tierras se realiza en forma violenta, desplazando a las comunidades de sus territorios. En Nicaragua, se ha denunciado el tr\u00e1fico de tierras ancestrales del Pueblo Rama, por parte de mestizos y l\u00edderes ind\u00edgenas, que a inicios del 2010 ingresaron armados a desplazarlos, y que han intentado impugnar el t\u00edtulo de propiedad otorgado a los Rama, con apoyo de grupos pol\u00edticos que realizan sus campa\u00f1as mediante el tr\u00e1fico de tierras7.
Situaci\u00f3n similar enfrenta la Comunidad Ind\u00edgena Ash\u00e1ninka Marankiari Bajo (CIAMB) en la Amazon\u00eda Peruana. Desde los 90`, sus tierras supuestamente desocupadas, son ilegalmente ofrecidas por pol\u00edticos aspirantes al gobierno local, a inmigrantes de otras partes del pa\u00eds, a cambio de votos. Hasta el a\u00f1o 2000, la CIAMB sufri\u00f3 una reducci\u00f3n del 50% de la superficie de sus tierras comunales8.
En el 2008, en Bolivia, el viceministro de Tierras Alejandro Almaraz denunci\u00f3 el intento de prefectos y senadores locales, Menonitas y empresarios brasile\u00f1os por apropiarse ilegalmente de 187.000 has en el Beni, por medio de falsificaciones y clonaci\u00f3n de documentos9. En todos los casos, el tr\u00e1fico de tierras se convierte en una seria amenaza a la propiedad de las tierras ancestrales, toda vez que se facilita la expulsi\u00f3n de los ind\u00edgenas por v\u00edas aparentemente legales.<\/p>\n
